In response, the Hyderabad City Police Department has issued a notification to regulate these activities, prioritizing public health and safety. The Dangers of DJ Sound Systems and Firecrackers Over recent years, the competition among procession organizers to use louder DJ sound systems has escalated. While these systems may enhance the festive atmosphere, they come with serious consequences for public health. Exposure to high decibel levels from DJ sound systems can lead to hearing loss, stress, and other health complications. The youth attending these processions often become overexcited, leading to indiscipline and chaos, which can complicate the efforts of the police and other government agencies responsible for maintaining order. Moreover, firecrackers, commonly used in these events, pose significant safety risks, especially in crowded areas. A recent incident on September 19, 2024, saw a generator powering a DJ system catch fire at Charminar, potentially caused by sparks from firecrackers. Although the situation was quickly brought under control, it created unnecessary panic and increased communal tensions. Public Complaints and Noise Pollution Public complaints about noise pollution in residential areas have surged, particularly through emergency hotlines like Dial 100. The excessive noise affects the health of elderly residents, disrupts children’s education, and disturbs the general peace. The Supreme Court of India, in a 2000 ruling, emphasized the harmful effects of noise pollution, including sleep disruption, stress, hearing loss, and potential law and order issues. In light of these concerns, regulating DJ systems and firecrackers has become a pressing necessity. Legal Framework for Sound Regulation in Hyderabad In response to these growing issues, the Hyderabad City Police, led by Commissioner C.V. Anand, has implemented strict regulations on the use of DJ sound systems and firecrackers during religious processions. Drawing authority from the Hyderabad City Police Act and the newly introduced Bharatiya Nagarik Suraksha Sanhita, these regulations aim to ensure public safety and maintain law and order. The regulations set specific sound decibel limits for different areas of the city, as defined in G.O.Ms. No. 172, issued by the Environment, Forest, Science & Technology Department. The permissible sound levels vary by zone: industrial areas (75 dB during the day, 70 dB at night), commercial areas (65 dB during the day, 55 dB at night), residential areas (55 dB during the day, 45 dB at night), and silence zones such as hospitals and educational institutions (50 dB during the day, 40 dB at night). Furthermore, the use of loudspeakers and DJ systems is strictly prohibited between 10:00 PM and 6:00 AM, in accordance with Supreme Court guidelines. Collaborative Efforts for Sound Regulation In a meeting held on September 26, 2024, Commissioner Anand convened a roundtable discussion with stakeholders, including religious procession organizers, political party leaders, and government department representatives. During this meeting, a detailed presentation highlighted the health risks associated with DJ systems and firecrackers. Real video footage showcasing the harmful noise levels produced by DJ systems was shared, along with testimonials from elders in various communities who spoke against the use of loud music in religious events. Organizers must adhere to the specified sound decibel limits for their respective areas. Firecracker Ban: Firecrackers are banned during all religious processions in Hyderabad to prevent accidents and ensure the safety of the participants and the general public. Permit Requirement: Organizers who intend to use sound systems within the permissible limits must obtain clearance from the police. This applies to both the organizers and the companies supplying the equipment. Legal Consequences for Violations Violators of these regulations will face strict legal penalties under various provisions of the Hyderabad City Police Act, the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Environment Protection Act. For instance, Section 67 of the Hyderabad City Police Act prohibits the use of fireworks in public places without authorization, while Section 76 addresses violations of rules made under the Police Act. Additionally, the Bharatiya Nagarik Suraksha Sanhita imposes penalties for creating public nuisances, disobedience to lawful orders, and making the atmosphere hazardous to public health. Under the Environment Protection Act, offenders may face imprisonment of up to five years or a fine of up to one lakh rupees, with additional fines for continued violations. In severe cases, offenders may be imprisoned for up to seven years.
