Cancellation of resolutions passed by certain Gram Panchayats


The Commissioner, Director of Municipal Administration has stated that the District Collector, Warangal District has sent a proposal for inclusion of surrounding Fourty two Gram Panchayats (42) into Warangal Municipal Corporation. Out of (42) Gram Panchayats, (11) Gram Panchayats i.e., (1) Allipur (2) Ayhodhyapuram (3) Bhattupalli (4) Kadipikonda; (5) Kummarigudem; (6) Paidipally (7) Chinthagattu (8) Pegadapally (9) Yellapur (10) Mogilicherla and (11) Rampur have agreed and remaining (31) Gram Panchayats have opposed for inclusion into the Warangal Municipal Corporation. Accordingly, show-cause notices to the (31) Gram Panchayats have been issued vide reference asking as to why the resolutions passed by them cannot be cancelled. In response to the show-cause notices, the District Collector, Warangal has obtained the views of all the above (31) Gram Panchayats vide reference and submitted to the Government stating that (4) Gram Panchayats i.e., (1) Vangapahad (2) Gundlasingaram (3) Kothapeta and (4) Palivelupula have accepted the proposed merger and (27) Gram Panchayats i.e., (1) Arepally (2) Enumamula (3) Gopalapuram (4) Kothapally (H) (5) Madikonda (6) Mamunoor (7) Nakkalapally (8) Tekulagudem (9) Taralapally (10) Thimmapur (H) (11) Bheemaram (12) Devannapet (13) Hasanparthy (14) Komatipally (15) Mucherla (16) Munipally (17) Dharmaram (18) Dupakunta (19) Gorrekunta (20) Potharajpally (21) Stambhampally (22) Vasanthapur (23) Janpaka (24) Unikicherla (25) Singaram (26) Bollikunta and (27) Gadepally have opposed the proposed merger on various reasons as mentioned in the respective resolutions including the reason that the existing taxes would be enhanced abnormally.

The Government have examined the objections raised by the above Gram Panchayats and found that the objections are mere apprehensions without any basis and that there is no substance in any of the objections put forth by the Gram Panchayats. The decision of merging the surrounding Gram Panchayats into Municipal Corporation has been taken in the larger interests of the people of the area keeping in view of its overall development and to improve better amenities to the public, and hence the Government have felt that the objections raised by the above Gram Panchayats are not maintainable and do not deserve consideration. Therefore, the Government have decided to cancel the resolutions passed by the respective (27) Gram Panchayats and also decided to include areas under the surrounding Fourty two (42) Gram Panchayats into Warangal Municipal Corporation of Warangal District.

The Government of Andhra Pradesh after examination have decided to cancel the Notification issued, declaring the Fourty two Gram Panchayats (42) i.e. (1) Allipur (2) Ayhodhyapuram (3) Bhattupalli (4) Kadipikonda (5) Kummarigudem (6) Paidipally (7) Chinthagattu (8) Pegadapally (9) Yellapur (10) Mogilicherla and (11) Rampur (12) Vangapahad (13) Gundlasingaram (14) Kothapeta (15) Palivelupula (16) Arepally (17) Enumamula (18) Gopalapuram (19) Kothapally (H) (20) Madikonda (21) Mamunoor (22) Nakkalapally (23) Tekulagudem (24) Taralapally (25) Thimmapur (H) 26) Bheemaram; (27) Devannapet (28) Hasanparthy(29) Komatipally (30) Mucherla (31) Munipally (32) Dharmaram (33) Dupakunta (34) Gorrekunta (35) Potharajpally (36) Stambhampally (37) Vasanthapur (38) Janpaka (39) Unikicherla (40) Singaram (41) Bollikunta and (42) Gadepally as Gram Panchayat, so as to include the said areas into Warangal Municipal Corporation.

NOTIFICATION-I

In exercise of the powers conferred under sub section (1) of section 246 of the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act. No. 3 of 1994) the Governor of Andhra Pradesh hereby cancels the following resolutions passed by the respective (27) Gram Panchayats of Warangal District opposing for merging the surrounding villages into Warangal Municipal Corporation.

In exercise of the powers conferred under clause (f) of sub-section (2) of section 3 of the Andhra Pradesh Panchayat Raj Act, 1994 (Andhra Pradesh Act No.13 of 1994) read with clause (i) of sub-rule (1) of rule 12 of the Andhra Pradesh Gram Panchayats (Declaration of Villages) Rules,2007 issued in G.O.Ms.No. 542, Panchayat Raj and Rural Development (Pts.IV) Dept., dt.3-12-2007, the Governor of Andhra Pradesh hereby cancels the Notifications issued declaring the Fourty two (42) Villages i.e., (1) Allipur; (2) Ayhodhyapuram (3) Bhattupalli (4) Kadipikonda (5) Kummarigudem (6) Paidipally (7) Chinthagattu (8) Pegadapally (9) Yellapur (10) Mogilicherla (11) Rampur (12) Vangapahad (13) Gundlasingaram (14) Kothapeta (15) Palivelupula (16) Arepally (17) Enumamula (18) Gopalapuram (19) Kothapally (H) (20) Madikonda (21) Mamunoor (22) Nakkalapally (23) Tekulagudem (24) Taralapally (25) Thimmapur (H), (26) Bheemaram (27) Devannapet (28) Hasanparthy (29) Komatipally (30) Mucherla (31) Munipally (32) Dharmaram (33) Dupakunta (34) Gorrekunta (35) Potharajpally; (36) Stambhampally(37) Vasanthapur (38) Janpaka (39) Unikicherla (40) Singaram (41) Bollikunta and (42) Gadepally as Gram Panchayat, so as to include the areas into Warangal Municipal Corporation.
