Public Auction for open plots in Sarika township at Amisthapur


TERMS & CONDITIONS :

The  participants  in  the  open  auction  /  sealed  tenderer  should  deposit amount per each plot as shown at Column No.(8)   of the above table with General Manager (P), APRSCL, Mahabubnagar at his office near  S a i  b a b a  T e m p l e ,  S a r i k a  T o w n s h i p ,  a t A m i s t h a p u r (V)  B h o o t h p u r  ( M ) ,  M a h a b u b n a g a r  ( D i s t ) ,  as  EMD  by  means  of  D.D./ Banker cheque, from any nationalized/schedule bank, obtained  in  favour  of  ‘The General Manager (P), APRSCL, Mahaboobnagar’.  Sealed tenders can be submitted quoting their price quoting the plot Number for which they are quoting i n a s e a l e d c o v e r .  Price quoted shall not  less than the  upset price.  D e m a n d  D r a f t  f o r  E M D  a m o u n t  s h a l l  b e  h a n d e d  o v e r  t o  t h e G M s  o f f i c e  a l o n g  w i t h  t h e  s e a l e d   c o v e r  a n d  o b t a i n e d  a  r e c e i p t  f o r  t h e  D D f u r n i s h e d a n d e a l e d c o v e r . The tenderer submitted sealed tender can also participate in the  open auction and the tenderer shall obtain a lot number before commencement of auction by producing the EMD deposit receipt. The EMD amount will not be accepted either in the form of cash OR cheque and it shall be paid only through Demand Draft/Bankers Cheque only.

2.   If the participant desires to  participate  in the open  auction only, should  submit  EMD  i.e.,

Demand Draft before commencement of auction and soon after the auction is completed EMD will  be  returned  duly  retaining  highest  bidder’s  EMD.  The  amount  of  EMD  will  not  be accepted  in  cash/ cheque. If any bidder wants to  participate in the public auction / sealed tender for more than one plot,  separate Demand Draft for each plot is to be submitted.

3.   After the bid is knocked down in the open auction , thereafter sealed tenders will be opened.

Corporation will consider the advantage  offer,   out of Open auction offer and Sealed Tender Offer.  The D.Ds of highest bidders of tender / auction will be retained by the corporation till a decision is taken by the  Managing Director on confirmation of auction.

4.   The  D.Ds of unsuccessful applicants will be returned to them after closure of auction.

5.   The  highest  bidder/tenderer should deposit  25% of the  bid amount  and 1% (One percent) auction expenses on the total bid amount Within 24 hours after the auction is closed and the balance of 75% bid  amount  should  be remitted 45 days from  the date of confirmation of auction letter by the Managing Director.   The Managing Director, reserves the right of confirming or rejecting the auction bid of anyone or all.

6.   Cash Discount: Highest bidder whose bid is accedpted bythe Managing Director, is entitled for the following cash discounts on the balance 75% amount, if they pay the balance 75% cost as follows:

I)        2% cash discount, if paid within 48 hours on receipt of confirmation. II)       1.5% cash discount, if paid within 7 days on receipt of confirmation. III)      1% cash discount, if paid within 15 days  on receipt of confirmation.

IV)       0.5% cash discount, if paid within one month onreceipt of confirmation.

7. For any extended period beyond 45 days and upto a maximum period of 3 months , a simple interest @ 18% per annum on the balance amount due to the corporation shall be charged on the request of the bidder only and subject to approval of the Managing Director.  Beyond

3 months,   if the bidder fails to pay ¾th cost, the auction shall automatically cancelled duly forfeiting the ¼ cost without a n y  notice. If the successful bidder needs extension beyond 45 days,  she / he should submit written request immediately before the expiry of 45 days.

8. For violation of conditions 5 & 7 above, 25% of bid amount and 1% auction expenses remitted by the successful bidder will be forfeited to the A.P. Rajiv Swagruha Corporation and the plot will be put to re-auction.

9 .  On receipt of total cost of plot along with auction expenses along with interest if any, the plot registered in the name of the highest bidder(s).  Registration charges are to be born by the Higher Bidder as per rules and regulations of Registration and Stamps Department.

10.  The highest bidder / tenderer shall has no legal right to claim the ownership of the plots till the tender cum auction is confirmed by the Managing Director and registered in his / her name.

11. Persons  desirous  of  offering  an  amount  higher  than  the  upset  price  fixed  by  the corporation as indicated above alone should participate in the tender cum auction.

12. The land shall be utilized for permitted purpose with the permission of  ompetent authority, duly following the rules and regulations of gated community.

13. The plots will be registered in favor of the highest bidder in tender-cum-auction purchaser only.

If more than one person jointly / firm represented by the individuals, the entire plot will be registered in their names jointly.  The full particulars of the person(s) to whom the plot shall be recorded at the time of auction.   No representation shall be entertained after closure of auction.

14. For further details and for identification of the plot, General Manager (P) b e s i d e  S a i  b a b a T e m p l e , S a r i k a  T o w n s h i p ,  a t  A m i s t h a p u r       (V)      B h o o t h p u r       ( M ) , M a h a b u b n a g a r  ( D i s t ) may be contacted on any working day during the office hours.

15. The plot offered for sale will be sold in tender-cum-auction, in the form and shape on in “ as is where condition” on the date of tender-cum-auction and it shall be responsibility  of  the tender-cum-auction  purchaser   to   satisfy   him/her   self  about   the condition  of  the  plot before   participation   in   the   tender-cum-auction.   The plot can be inspected during office hours i.e., 10.30 A.M. to 5.00 P.M.   The A.P. Rajiv Swagruha Corporation will not entertain any kind of objection after the bid is knocked down in favor of highest bidder/tenderer.

16. If  any  water/electricity/telephone  lines  or  poles  passing/installed  in  the  plot,  it  is  the responsibility of the tender cum auction purchaser to get them removed from the plot at his/ her own expenses.  The APRSCL will not entertain any representation in the matter.

17. The names of the auction bidder and the person in whose favour property proposed to be registered shall be recorded simultaneously in the auction forms and auction sheet on the day of auction only. Thereafter no incusion of names for registration will be entertained,  except family members i.e wife, husband, son and daughter in law with proof.

18. In the event of change of name if any it shall be intimated by the successful bidder to the auctioning authority before the closure of the auction process.

19. The Managing Director is the final authority either to accept or to reject any or all the bids and reserve the right to cancel the tender-cum-auction without assigning any reasons thereof.

20. As per approved layout by the Urban local bodies, roads, and sites are shown. Tender-cum- auction of the site will be in the context of approved layout and on the basis of physical measurements, as on the date by tender-cum-auction.

21. The minimum stack in the auction is proposed to increase from Rs.100/- and  above.

22. If any dispute/court case arises out of this auction, the matter will be dealt in the courts of the Mahaboobnagar District Courts only.

23. If any sealed tenderer quotes less than the upset price in the Sealed Tender, the EMD will automatically forfeited and they will be disqualified.

24. If the highest offer in the sealed tender and the knocked down price is one and the same between different individuals, then auction between the open tenderor and sealed tenderor will be conducted and the highest of the above will be considered, as highest bid amount.

25. Once a sealed tender is received with the application it will not be return or allowed to be withdrawn under any circumstances and the rate tendered there in shall be binding in case of acceptance of the same.

26. The auction will be held at the place and date as given in the notification/ Advertisement.

27. On payment of the entire consideration money together with interest due to the M.D, APRSCL, on account of site, the purchaser shall have to execute a deed of conveyance in the prescribed form and in such manner as may be directed by the M.D, APRSCL within a period of six weeks of the payment of entire consideration money together with interest or any other amount due to the APRSCL on account of transfer of the land. The purchaser has to bear the registration amount and stamp duty as per Act.

28. The Site Plans are displayed in the office of the APRSCL and also at the site office .

29  The  allotment  is  also  subject  to  directions  of  the  Government  and  such  other  terms  and conditions  as  may  be  communicated  to  APRSCL  from  time  to  time  and  the  same  will  be announced prior to conducting the open auction.

30  The APRSCL will not take any responsibility for delay in release of connections.

31  The nomination given in the application is valid till the Plot / Site is registered in favour of the applicant / allottee.

32  Intimation  of  ‘Confirmation  of  auction’  or  otherwise  as  the  case  may  be,  will  be  sent  by Registered Post to the address given in the application. In case of non-receipt of such intimation, it shall be the responsibility of the applicant to personally obtain a duplicate copy of the notice from the office of APRSCL. Non-receipt of notice by the applicants shall not be a ground for non- payment of the sale price or for delayed payment.

33   All the correspondence will be made to the address given in the application form. It shall be the responsibility of the applicant to inform any change in the address obtaining acknowledgement from APRSCL.

34  In all matters of doubts or disputes or in respect of any matter not provided for in these terms and conditions, the decision of the Managing Director, APRSCL shall be final and binding.

35  The  areas  shown  against the  each  plot is  subject  to actual  measurement at  the  time  of registration and difference cost will be collected, if any excess area is arrived at the auction rate and if less area is arrived, the cost of the less area will be refunded at the auction rate.

36  If the dates mentioned above, happens to be holiday in unforeseen circumstances the auction will be conducted on next working day.

37. The  terms  and  conditions  of  the  auction-cum-bid  is  also  available  on  the  website www.rajivswagruhaap.gov.in.
