NOTIFICATION N0.3038[TSEC-ULBs[2019 Dated:23.12.2019 In exercise of the powers conferred by Articles 243-K and 243-ZA of the Constitution of India, read with Section 195 of the Telangana Municipalities Act, 2019, (Act No. 11 of 2019), the State Election Commission, Telangana, hereby, NOTIFIES the “election schedule” for conduct of Ordinary Elections to the Municipalities and Municipal Corporations indicated in the schedule appended to this Notification. By virtue of this notification the Model Code of Conduct shall come into force with immediate effect.

Setting up of Polling Stations-Publication of list of Polling Stations in Municipalities and Municipal Corporations based on the publication of Electoral Rolls on 04.01.2019, w.r.t. 01.01.2019 as the qualifying date— Regarding

The State Election Commission, Telangana issued Notification in the reference 1 st cited for preparation and publication of Ward wise Electoral Rolls for the conduct of elections to the Municipalities and Municipal Corporations in the State. The draft Photo Electoral Rolls of the Municipalities and Municipal Corporations will be published on 30.12.2019 and final electoral rolls will be published on 04.01.2020.
Circular instructions were already issued by the Commission on the Setting up of Polling Stations for the conduct of elections to Ward Members of Municipalities and Municipal Corporations vide reference 2nd cited. The said copies are also available in the TSEC website tsec.gov.in
The final list of Polling Stations of the Municipalities and Municipal Corporations shall be prepared and published as per the schedule is given below based on the Ward Wise final Electoral Rolls to be published on 04.01.2020 by adopting
Assembly Electoral Rolls with reference to 01.01.2019 as the qualifying date.

The Collectors & District Election Authorities are requested to see that the process is completed by 13.012020.
The preliminary arrangements for the setting up of Polling Stations should be initiated forthwith. The Commissioners of Municipalities and Municipal Corporations should be entrusted with the work of identification of Polling Stations, preparation of list of Polling Stations, Publication of draft and final list of Polling Stations.

The District Collectors should obtain the Polling Stations lists from the Municipal Commissioners concerned scrutinize and approve them before their final publication. The Returning Officers of Municipalities/ Municipal Corporations concerned should also be instructed to physically inspect the buildings proposed for Polling Stations of the Municipalities/ Municipal Corporations.

The Polling Station wise Electoral Rolls (without photos) of the Municipalities/ Municipal Corporations shall also be published in the web portal of the Municipalities/ Municipal Corporations concerned and TSEC on 13.01.2020. Circular instructions issued in this regard vide Ref. shall be followed.

Ordinary Elections to Municipalities- Identification of ST, SC, BC and Women Voters- Time schedule issued-Reg

A schedule was issued for identification of ST, SC, BC and Women voters in the Municipalities on par with preparation and publication of electoral

rolls in the Municipalities duly taking electoral rolls published on 01.01.2019. Accordingly, the same was completed and final publication was done on 16.07.2019. However due to certain court cases further process could not be taken up.

  1. In the meantime Government cited have issued the fresh schedule for the division of Municipalities into wards in all the 131 Municipalities in the State and accordingly the final publication was made by the Government for 130 Municipalities ( except Zaheerabad) on 17.12.2019.
  2. In reference 7th cited, the State Election Commission has issued a schedule for publication of ward wise electoral rolls in the Municipalities in the State with reference to 01.01.2019 as qualifying date duly adopting the latest draft Assembly constituency electoral Rolls in toto. In view of above, in order to finalize the reservations of the wards, the identification of ST, SC, BC and Women voters has to be taken up duly considering the supplementary roll and ward wise final voters list shall be prepared
  3. In this regard, the following time schedule is issued for identification of ST, SC, BC
    and Women voters in 136 Municipalities.

  4. Claim for identification of names as ST, SC, BC and Women 31.12.2019 to 01.01.2020

Disposal of Claims and Objections:

Claim for identification of names as ST, SC, BC and Women Objection for identification of a name as ST, SC, BC and Women others shall be in Form-3 Concerned ST, SC, BC and Women voter identification Officers.
1. In respect of objections, the ST, SC, BC and Women voter Identification Officer shall issue a Notice in Form-5 to be served on the objector and also the person objected to.
2. simultaneous inquiry of finalization of objections and updating of draft Electoral Rolls marked with ST, SC, BC and Women voters.
Sorting out the claims and objections ward wise Field verification of claims and objections by the Verification officer
3 . Marking of ST,SC, BC and Women voter voters in the Electoral Rolls after verification.
4 Publication of final list of worldwide ST, SC, BC, and Women voter voters and submission of final BC voters list to the C&DMA
5.The Municipal Commissioners of GHMC, GWMC, Khammam, Atcham pet, Siddipet and Zaheerabad are requested to take up only BC voters identification as per the above schedule on the whole duly considering the latest Electoral rolls and furnish the information to this office on 04.01.2020.
6.Therefore, the Municipal Commissioners noted in the address are hereby instructed to adhere the above time schedule and complete the identification of ST, SC, BC and Women voters survey and submit the final voters list to this office for taking further action in the matter.

The Telangana Municipalities (Reservation of seats in Municipal Corporations and Municipal Councils) Rules, 2019

In exercise of the powers conferred by sub-section (1) of section 238 read with section 7 of the Telangana Municipalities Ordinance, 2019 (Ordinance No.6 of 2019) and in supersession of all previous rules issued on the subject, the Governor of Telangana, hereby makes the following rules for the reservation of seats in Municipal Corporations and Municipal Councils in the State.

(i) These rules may be called the Telangana Municipalities (Reservation of seats in Municipal Corporations and Municipal Councils) Rules, 2019;

(ii) These rules shall apply to all Municipal Corporations and Municipal Councils (except Greater Hyderabad Municipal Corporation constituted in the State under and any Greater reference Hyderabad to a Municipality Municipal Corporation wherever it Act, occurs 1955)in these rules shall apply to Municipal Corporation and Municipal Council.

In these Rules unless the context otherwise requires,-

(i) “Ordinance” means the Telangana Municipalities Ordinance, 2019;

(ii) “Authority specified” means any officer or officers of the Government specified by the Government delegating their powers for the purpose of fixation of number of seats reserved for various categories; and reserving wards to the reserved categories in Municipal Corporations and Municipal Councils.

The number of members to be elected in each Municipal Corporation and Municipal Council is as mentioned in Column No. 4 of schedules I and Il of the Ordinance. The Government or authority specified shall declare by Notification in the Telangana Gazette the number of seats reserved in each Municipality for Scheduled Tribes, Scheduled Castes, Backward Classes and Women and also the wards reserved to these categories under section 7 of the Ordinance.

The number of seats reserved in each Municipality for Scheduled Tribes, Scheduled Castes, Backward Classes and Women shall be in the following manner:-

(iii) No. of seats in respect of Scheduled Tribes:

(a) Total population of Scheduled Tribes in the Municipality X 100 = Total population of the Municipality

(b) Total number of wards in the Municipality X A% = “B” No. of seats 100 M B” Number of seats shall be reserved for Scheduled Tribes in the Municipality. No. of seats in respect of Scheduled Castes :

(a) Total population of Scheduled Castes in the Municipality ———— x 100= Total population of the Municipality

(b) Total number of wards in the Municipality —- X C% = No. of seats
100 “D” Number of seats shall be reserved for Scheduled Castes in the Municipality.

  1. After finalizing the number of seats in a Municipality to be reserved in favour of Scheduled Tribes and Scheduled Castes, seats shall be reserved for Backward Classes, such that the total reservations shall not exceed 50% of the total wards of the Municipality.

1.1 Example: If the total number of wards in the Municipality is 100, 10 seats are reserved for Schedule Tribes and 15 seats are reserved for Schedule Castes, number of seats to be reserved for Backward Classes shall be 25 (i.e., (100/2) 25).

  1. While determining seats in a Municipality to be reserved in favour of Scheduled Tribes and Scheduled Castes any fraction of less than one half 91 shall be ignored and any fraction equal to or more than one-half shall be counted as one.
  2. Where the proportion of the population of the Scheduled Tribes or Scheduled Castes in a Municipality, as the case may be, to the total population of the Municipality, does not constitute required proportion enabling them for reservation of at least one seat, there shall be reserved one seat for these categories without reference to the said proportion.
  3. Fifty (50) per cent of seats reserved for Scheduled Tribes, Scheduled Castes and Backward Classes shall be reserved for Women belonging to these categories: Provided that where only one ward is reserved for Scheduled Tribes or Scheduled Castes, as the case may be in a Municipality, no seat be reserved for women belonging to Scheduled Tribes or Scheduled Castes.
  4. Out of the total number of seats 50% of the seats (including the number of seats reserved for Women belonging to Scheduled Tribes, Scheduled Castes and Backward Classes) shall be reserved for women in the Municipality. If there is a difficulty in reserving 50% of seats to women due to “odd number of seats” in a Municipality, the fraction shall be ignored.
  5. The remaining seats shall be considered as unreserved seats in the Municipality.
  6. The population as ascertained at the latest census as published by the census authorities shall be taken for the purpose of finalizing the number of seats for various categories and setting apart the wards for these categories
  7. In cases, where the number of seats reserved for Scheduled Tribes and Scheduled Castes itself exceeds 50% of the total seats in a Municipality, the ceiling of 50% of total reservations shall not apply to that Municipality and in such cases, there shall be no reservation for Backward Classes. In such cases, reservation of seats for women belonging to Scheduled Tribes, Scheduled Castes and unreserved categories shall be made as noted above.
  8. The Government or the Authority specified, shall. issue final Notification fixing the number of seats reserved for various categories in the Municipalities and publish it in the Telangana Gazette and in the concerned District Gazette.
  9. After fixing the number of seats set apart for Scheduled Tribes, Scheduled Castes, Backward Classes, Women and Unreserved categories, reserving different wards in respect of Scheduled Tribes, Scheduled Castes and Backward Classes in a Municipality shall be done with reference to the largest percentage of voters of the said category to the total number of voters of the ward in the Municipality concerned in descending order.
  10. The reservation of wards for various categories shall be made in the order of Scheduled Tribes, Scheduled Castes and Backward Classes.
  11. The wards to be reserved for women shall be done through draw of lots by the District Collector concerned jn the presence of the representatives of political parties which are registered with the State Election Commission. The lots shall be drawn only from among the wards reserved for that category. Example: if X and Y are two wards reserved for Scheduled Tribes, one among them shall be reserved for women by draw of Lots among X and Y only.
  12. Reservation of wards for Scheduled Tribes, Scheduled Castes, Backward Classes and Women made after the commencement of the Ordinance for the first time under the provisions of Telangana Municipalities Ordinance, 2019, shall remain in force for two consecutive terms. Thereafter, the seats shall be reserved by rotation to different wards in a Municipality. The Municipal Commissioner shall maintain a register for this purpose: Provided that whenever an exercise for division of Municipalities has been taken up, the cycle of reservation of seats shall start afresh.
  13. The Government or the Authority specified, shall issue final Notification regarding determination of wards to be reserved to Scheduled Tribes, Scheduled Castes, Backward Classes and Women in the Municipalities and publish it in the concerned District Gazette.

The Telangana Municipalities (Reservation of offices of Chairpersons in Municipal Councils) Rules, 2019

In exercise of the powers conferred by sub-section (1) of section 238 and section 287 read with section 28 of the Telangana Municipalities Ordinancet 2019 (Ordinance No.6 of 2019) and in supersession of all previous rules issued on the subject, the Governor of Telangana, hereby makes the following rules for the reservation of offices of Chairpersons in the Municipal Councils in the State.

(i) These rules may be called the Telangana Municipalities (Reservation of offices of Chairpersons in Municipal Councils) Rules, 2019;

(ii) These rules shall apply to all Municipal Councils in the State.

In these Rules unless the context otherwise requires: “Ordinance” means the Telangana Municipalities Ordinance,2019; means the Government of Telangana.

The Government shall declare, by Notification, in the Telangana Gazette, the number of offices of Chairpersons of Municipal Councils to be set apart in the State for Scheduled Tribes, Scheduled Castes, Backward Classes and Women under section 28 of the Ordinance in the following manner:(i) Offices in respect of Scheduled Tribes:

(a) Total population of Scheduled Tribes in all Municipal Councils in State – X 100 = Total population of all the Municipal Councils in the State.

(b) Total number of offices of Chairpersons in the State ————– mines ———————- X A % = No.of Offices 100 “B” Number of offices of Chairpersons shall be set apart for Scheduled Tribes in the State.

(ii) Offices in respect of Scheduled Castes:

(a) Total population of Scheduled Castes in all Municipal Councils in the State—————-mines ———————- x 100 = Total population of all the Municipal Councils in the State.

b) Total number of offices of chairpersons in the State x C % = “D” No. of Offices 100 “D” Number of offices of Chairpersons shall be set apart for Scheduled Castes in the State.

After finalizing the number of offices of Chairpersons to be set apart in favour of Scheduled Tribes and Scheduled Castes, number of offices of Chairpersons set apart for Backward Classes shall be fixed, such that the total number of offices so reserved, shall not exceed 50% of the total offices of Chairpersons in the State.

While determining the number of offices of Chairpersons in the State to be set apart in favour of Scheduled Tribes or Scheduled Castes or Backward Classes as the case may be, any fraction of less than one half shall be ignored and any fraction equal to or more than one half shall be counted as one.

Where the proportion of the population of the Scheduled Tribes or Scheduled Castes in the State, as the case may be, to the total population of the State, does not constitute a required proportion enabling them to set apart at least one office of Chairperson, there shall be reserved one office of Chairperson for these categories without reference to the said proportion.
Fifty (50) percent of the total number of offices of Chairpersons set apart for Scheduled Tribes, Scheduled Castes and Backward Classes shall be reserved for women belonging to the Scheduled Tribes, Scheduled Castes and the Backward Classes respectively.
Out of the total number of offices of Chairpersons in the State, 50% of the offices of Chairpersons (including the number of offices reserved for Women belonging to Scheduled Tribes, Scheduled Castes and Backward Classes) shall be set apart for women. If there is a difficulty in reserving 50% of offices of Chairpersons to women due to “odd number of offices” in the State, the fraction shall be ignored.
After reserving the offices of Chairpersons for the above categories, the balance number of offices of the Chairpersons shall be considered unreserved.

  1. The population as ascertained at the latest census as published by the census authorities shall be taken for the purpose of setting apart the number of offices of Chairpersons reserved in respect of Scheduled Tribes and Scheduled Castes.
  2. The reservation of offices of Chairpersons shall be started afresh beginning from the first ordinary elections held after the commencement of the Telangana Municipalities Ordinance, 2019.
  3. The reservation of offices of Chairpersons for various categories as set apart above, shall be made in the order of Scheduled Tribes, Scheduled Castes, Backward Classes and Women as mentioned below:-

A.SCHEPVLE-P. TRIBES AND SCHEDULED CASTES

The reservation of offices of Chairpersons for members belonging to Scheduled Tribes shall be made with reference to the largest percentage of population of the said category to all the Municipal Councils in the State in the descending order. After determining the Municipal Councils reserved for the Scheduled Tribes, the offices of Chairpersons reserved for Scheduled Castes shall be made with reference to the largest percentage of population of the said category to all the Municipal Councils in the State in descending order, duly excluding the Municipal Councils already reserved for Scheduled Tribes.

BACKWARD CLASSES

The offices of the Chairpersons in respect of Backward Classes shall be so reserved with reference to the largest percentage of voters belonging to Backward Classes in the Municipal Council to the total voters in all the Municipal Councils in the State in descending order, duly excluding the Municipal Councils already reserved for Scheduled Tribes and Scheduled Castes. Out of the Municipal Councils, 50% of the reservation (including those reserved for Scheduled Tribes, Scheduled Castes and Backward classes, including the fifty percent of offices to be reserved for women among the total number of offices) shall be made to women belonging to these categories by draw of lots in the presence of representatives of Political parties registered with the State Election Commission by the Director of Municipal Administration, Hyderabad.

  1. Where there is difficulty in reserving offices of Chairperson for one or more categories in a Municipal Council due to equality in fraction or otherwise, the Government shall determine the category to which the offices of Chairpersons shall be reserved by draw of lots.
  2. The offices of Chairpersons reserved after the first ordinary election held after commencement of Telangana Municipalities Ordinance, 2019 for Scheduled Tribes, Scheduled Castes, Backward Classes and Women shall continue to be in force for two consecutive terms and thereafter be allotted by rotation to different Municipal Councils in the State. The Director of Municipal Administration shall maintain a register for this purpose.
  3. The Government shall finally issue a Notification declaring the number of offices of Chairpersons in the State reserved in respect Of Scheduled Tribes, Scheduled Castes, Backward Classes and Women in the State and the Municipal Councils to which these offices are reserved and publish it in the Telangana Gazette.

Instructions to DEOs, EROS, AEROs to undertake a special drive to process applications filed under continuous updation photo electoral rolls of Municipalities and Municipal Corporations Election in January 2020

State Election Commission issued notification for preparation and publication of ward wise photo electoral rolls of Municipalities and Municipal Corporations with reference to 01.01.2019 as qualifying date duly adopting datest Assembly Electoral Rolls and final MERs will be published on 04.01.2020 for conduct of Ordinary Elections to ULBs as provided under Section 195-A of Telangana Municpalities Act, 2019. Any amendment, transposition, deletion or inclusion of names in the electoral roll of the Assembly Constituencies concerned made by the Electoral Registration Officers under Section 22 or 23 of Representation of People Act, 1950, upto the date of election notification for any election held under the Telangana Municipalities Act, 2019, shall be carried out in the electoral roll of the Municipality [Municipal corporation and such changes to be carried out to the concerned Ward electoral Roll.

After publication of draft photo Electoral rolls on 30.12.2019, it is anticipated that considerable number of applications will be filed under Section 22 and 23 of RP Act, 1950 availing continuous revision provided under Section 195-A of Telangana Municipalities Act, 2019 to get their names tra%sposed, deleted or included in the Assembly Electoral Roll. All such changes in the Assembly Rolls till the date of Election Notification are required to be carried forward in to the Municipal Electoral Rolls of the Urban Local Bodies and consequently in the concerned.

1, therefore request the Chief Electoral Officer, GAD(Elections) Dept, Telangana to direct all the District Election Officers in the state of Telangana (except Hyderabad) to issue instructions to the EROS concerned having jurisdiction over the Municipality/Municipal Corporation concerned to dispose of all the claims and objections pending and filed with them immediately as per the procedure laid down in RPI Act.

I further request you to kindly make necessary arrangements in providing the computerised password free Assembly photo electoral rolls database in SQL (*.dmp format) of entire State of Telangana prepared and published w.r.t 01.01.2019 as the qualifying date updated from 16.12.2019 to 07.01.2020 to the Telangana State Election Commission as the election Notification will be issued on 7.01.2020.

The Telangana State Election Commission undertakes that, the shared password free database of the Assembly Electoral rolls (digital format) provided by the Election Commission of India and updated database of the Telangana State Election Commission will not be passed on to any other agency organization. Full Security of the database is ensured and its safe keep and bonafied use shall be the responsibility of State Election Commission.
