Jain Community as Religious Minority in the State of Telangana

All India Digamber Jain Organizations Co-ordination Committee, New Delhi, has stated that before bifurcation of erstwhile Andhra Pradesh State, Jain Community of Andhra Pradesh State was notified as Minority Community vide G.O. read above. Since now Telangana is an independent State it is necessary to issue afresh minority notification by the Government of Telangana.

As per Article (30) of the Constitution of India, a community can be declared as Minority, based on religion and language. Those Minorities will have certain privileges like running educational Institutions exclusively for their Minority Community. The then Minister for Minority Affairs in his letter dated 08-01-2007, to the Chief Minister had stated that a religious community which is less than 0.5 % will definitely fall under the category of religious Minority Community and they should be formally notified by the respective State Governments as Religious Minority Community. In the State of Telangana as per Census-2001, the population of Jains is 26,690 out of the total population of 3.51 Crores, which is 0.075% only. Jains belong to a distinct religion different from Hinduism.

The Ministry of Minority Affairs, Government of India, in their Letter F.No.1-28/2009- NCM, dated 30th July, 2010, informed that, for the purpose of determining the Minority, the unit should be State and not whole of India. Thus, the religious and linguistic Minority under Article 30 of the Constitution of India will be considered State-wise.

Government after careful examination of the matter, decided to notify the Jain Community, who are residing in the State of Telangana as Religious Minority in addition to the other Minority Communities already notified.

Jain Community Telangana NOTIFICATION

“in view of the Law laid down by the Supreme Court of India in T.M.A. Pai Foundation V/s. State of Karnataka [2002 (8)] Scale (1) and clarification given by the Ministry of Minority Affairs, Government of India in their Letter F.No.1-28/2009-NCM., dated 30-07-2010, the Governor of Telangana hereby declares that the “Jain Community” as a Minority Community in the State of Telangana for the purpose of Clause (1) of Article 30 of the Constitution of India”.
