The Director of Mines & Geology, Hyderabad in the reference , has reported that M/s Penna Cements Industries Limited is holding six Mining Leases as on 19.3.2008 in Ananthapuramu, Kurnool & Nalgonda Districts. The total extent held by the Company is 1105.975 Hectares. Orders were issued vide G.O. , Granting Mining Lease over an extent of 106.86 Hectares and vide G.O.Ms.No. 82, Ind& Com (M.III) Department, dated 19.3.2008 granting Mining Leases over an extent of 18.615 Hectares to M/s Penna Cement Industries Limited . On verification it has come to the notice of Government that M/s Penna Cement Industries Limited is holding 1105.975 Ha i.e., 11.06 Sq.Kms in which the Government of India, did not issue prior approval. The M/s Penna Cement Industries is holding Mining Leases alltogether an extent of 1105.975 Hectares which is in excess of 10 Sq.Kms, limit prescribed under Section 6(1)(b) of Mines & Mineral (D&R) Act, 1957. Hence, the grant is treated as void as per section 19 of Mines & Mineral (D&R)Act,1957.
Government, after examination of the matter, here by withdraw the Mining Leases granted to M/s Penna Cement Industries Limited vide G.O.Ms.No.71, dated:12.03.2008 in Sy.Nos.1 to 4, 45P etc., of Talaricheruvu Village, Tadipatri (M), Anantapuramu District and G.O.Ms.No.82, dated:19.03.2008 in Sy.No.146/P of Talaricheruvu (V), Tadipatri (M), Anantapuramu District, as the company has not yet executed the Mining Leases granted.
The Director of Mines & Geology, Hyderabad shall take further necessary action in terms of the applicable Mining Rules & Regulations
