The Andhra Pradesh Licence of selling by Bar Rules

Privilege by Bar for the sale of Indian Made Foreign Liquor and Foreign Liquor to be consumed on the licensed premises. 

 

a) Rs.25,00,000/- (Rupees  twenty five lakh only) per year in places where the population of the Municipality does not exceed 50,000.
b) Rs.35,00,000/- (Rupees thirty five lakh only) per year in places where the population of the Municipality/ Municipal Corporation is above 50,000 but does not exceed 5,00,000.
c) Rs.38,00,000/- (Rupees thirty eight lakh only) per year in places where the population of the Municipality/ Municipal Corporation is above 5,00,000 but does not exceed 20,00,000.
d) Rs.31,00,000/- (Rupees thirty one lakh only) per year in places where the population of the Municipality/ Municipal Corporation is above  20,00,000.
Provided that the licence fee in respect of a Bar situated in a village/town, any part of which is within a belt of 5 km from the periphery of a Municipal Corporation measured in a straight line on the horizontal plane shall also be at the rate of licence fee of Bar situated within the limits of such Municipal Corporations.
Provided  further that the licence fee in respect of a Bar situated in a village/town, any part of which is within a belt of 2 km from the periphery of Municipalities, measured in a straight line on the horizontal plane shall also be at the rate of licence fee of Bar situated within the limits of such Municipalities.
Provided also where the Bar falls within the belt area of a Municipal Corporation as well as a Municipality, the licence fee payable shall be the fee applicable to the Bar situated in the belt area of the Municipal Corporation.
Provided also that licence fee in respect of a Bar situated in a Tourism Centre notified by the Tourism Department of the State Government or Central Government shall be at the rate of licence fee of a Bar situated within the limits of the nearest Municipality or Municipal Corporation, as the case may be, measured in a straight line on the horizontal plane.

In exercise of the powers conferred by section 72 read with sections 17, 28 and 29 of the Andhra Pradesh Excise Act, 1968 (Andhra Pradesh  Act 17 of 1968) the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Excise (Grant of Licence of Selling by Bar and Conditions of Licence) Rules, 2005 issued in G.O.Ms.No.997, Revenue (Ex.II) Department, dated the 24th May, 2005 and published in the Andhra Pradesh Gazette No.17 (Extraordinary) Rules Supplement to Part II dated 24.05.2005 and amended from time to time.

AMENDMENTS

        In the said rules:

in rule 4 of the said rule after  the words “as notified by the Department of Tourism of Central Government or the State Government” the words  “in the tourism policy 1998 vide G.O. Ms.No. 5 & 6, YAT&C(T) Dept., dated 18.12.1998 and the tourism resorts registered with Tourism Department in order to promote tourism in the State” shall be added.

–> in rule 10 (A) for the words five times the words “six times” shall be substituted.

–> in rule 10(2) after the words “ on the basis of population” the words “and other factors”  may be inserted”.

iv.   in rule 13(3) after the words by the local authority”  the words “in  the  same local  jurisdiction where the bar is located” shall be  added.
