The Commissioner of Labour, Andhra Pradesh, Hyderabad has reported that the conciliation meetings conducted with the Management and Unions of APSRTC regarding the dispute i.e., regularization of services of all Contract Drivers and Conductors recruited in the regular vacancies of Drivers and Conductors etc. As the Conciliation meetings are failure, the Unions are proposed to go on strike w.e.f 05.07.2013.
The Commissioner of Labour, A.P., Hyderabad has further reported that the APSRTC is a Public Transport Organization and declared as Public Utility Service under the Industrial Disputes, Act, 1947. If, the strike proposed by the Unions materializes, it will cause lot of inconvenience to the public besides running the financial position of the Public Organization and the Commuters. It will also affect the financial viability of the organization in long run. There is a danger for the public safety, if the public are compelled to travel by private Lorries or other private means of transport and industrial peace also will be disturbed. It is, therefore, essential enforce Sec.10-B of the industrial Disputes Act, 1947 (inserted by AP Amendment Act.32 of 1987).
The Commissioner of Labour, A.P., Hyderabad has further reported that the dispute between Unions of APSRTC and the management regarding “regularization of services of Drivers and Conductors appointed on contract basis “ has already been referred by him for adjudication to the Labour Court-I, Hyderabad. The result is awaited.
After careful examination of the entire matter and in exercise of the powers conferred under Section 10-B of Industrial Dispute Act, 1947, Government herby prohibit the strikes in APSRTC in connection with the industrial disputes pertaining to “regularization of services of Drivers and Conductors appointed on contract basis “ subject to condition that the Management of APSRTC, Hyderabad shall complete the process of obtaining permission for regularization of the services of Drivers and Conductors appointed on contract basis within a period of three months.
The Commissioner of Labour, Andhra Pradesh, Hyderabad shall take necessary action accordingly.
