Scheme for maternity benefit to the registered woman building worker 1


The Andhra Pradesh Building and Other Construction Workers Welfare Board resolved to implement a scheme for providing maternity benefit to the registered building or other construction woman worker and Government vide G.O. had issued orders approving the scheme for providing Rs.5000/- towards maternity benefit to the registered building or other construction woman worker having institutional delivery and the claim should be made within one month from the date of delivery. Government issued further orders vide G.O. extending the time limit to six months.

The Andhra Pradesh Building and other Construction Workers Welfare Board through Commissioner of Labour vide letter 4th read above has submitted a proposal stating that the maternity benefit of Rs.5000/- was fixed three and half years ago and the workers and trade unions were regularly representing to enhance the amount of benefit and also to extend the benefit to the wife of the registered building worker and two daughters of the registered building and other construction workers since it is a tradition among the majority to have the deliveries of their daughters marriage arranged by the parents, meeting the expenditure and the Andhra Pradesh Building and Other Construction Workers Welfare Board in its 13th meeting held on 29-04- 2013 had resolved to enhance the amount from the existing Rs.5000/-, to Rs.10,000/- restricting to two deliveries of woman worker or wife of worker and also to extend the benefit to two daughters of the registered building and other construction worker for two deliveries. The maternity benefit would be available only for the delivery after 12 months of registration of the worker. It was also submitted in the proposal that the Hon’ble Supreme Court of India directed the Government in WP No.318 of 2006 to utilize the available fund substantially to extend benefits to the building workers.

Section 22 of the Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Services) Act, 1996 empowers the Board constituted under the Act to provide welfare measures and facilities to the Building and Other Construction Workers registered as beneficiaries with the Board and it is required in accordance with Rule 33-L of Andhra Pradesh Building and Other Construction Workers (Regulation of Employment &  Conditions of Service) Rules, 1999 that Government have to give approval to such schemes.

In the circumstances stated above, after careful examination of the proposal and in supersession of the order issued in the G.O. 1st read above, the Government hereby issue the following guidelines for maternity benefit to the registered women building workers and to the wife of the registered building male workers and also to their daughters from the date of issue of this order:-

(1) The scheme is applicable to the building and other construction workers registered as beneficiaries of the Board.

(2) The maternity benefit would be available only for the delivery after 12 months of registration of the worker.

(3) Maternity benefit of Rs.10,000/- may be paid for each delivery to the woman building worker up to two deliveries.

(4) Maternity benefit of Rs.10,000/- may also be paid for each delivery limited to two deliveries, to the wife of the male building worker and also two daughters of any registered building worker, male or female.

(5) Maternity benefit shall be paid only by way of remittance in the bank account of the worker.

(6) The Andhra Pradesh Building and Other Construction Workers Welfare Board may prescribe the claim application, further norms/guidelines/ procedure for settlement of the claims which shall be simple and minimal so as to secure the benefit in all deserving cases.

(7) The Andhra Pradesh Building and Other Construction Workers Welfare Board shall consult the department of Insurance Medical Services or Medical and Health department for guidance.
