Revising date of Probation for Hostel Welfare Officers 2


Government of Andhra Pradesh have issued orders that a candidate appointed to any of the posts either by direct recruitment or by promotion shall unless he has already passed, pass the Accounts Test for Subordinate Officers- Part.I during the period of his probation.

Andhra Pradesh Social Welfare Sub-ordinate Services Rules re-issued by repealing  the special and ad-hoc rules by stipulating that nothing in these rules shall effect the appointment made in accordance with the repealed rules prior to the commencement of these rules.

As per rule 16 (c) of AP State and Sub-ordinate Service Rules, 1996 in case of Direct Recruitment, the prescribed period of probation is two years on duty within a continuous period of three years. Where tests are prescribed for declaration of probation in the special rules, the employees shall pass such tests within the period of probation as per rule 16(e) of APS&SS rules. As per Rule 16(f) of the said rules the appointing authority shall discharge such candidates, who fail such tests or acquire such special qualification as prescribed in the special rules within the period of probation unless the period of probation is extended under the sub-rule (b) of the rule 17 of APS&SS rules. The appointing authority is empowered to extend the period of probation as per rule 17 of the said rules for a period of one year so as to enable such employees to pass the tests.

The Hon’ble APAT, Hyderabad in Order dated 05-05-2010  in  O.A.No.  4927,  4928,  4929,  4860,  5327  and  5642/2009  filed  by D.Srinivasa Rao, HWO, SWBH, Jaladanki, Nellore District and Sk.Rasoom Ahamad, HWO,  SWBH-III,  Gandavaram  (v),  Polavaram  mandal,  Nellore  district  issued  the following orders:

The Respondents (1st Respondent is the Government of Andhra Pradesh, rep. by its Principal Secretary, Social Welfare Department, Secretariat,

Hyderabad) are therefore, directed to finalize the seniority list of Wardens Grade-II by following the Rules i.e., Rule-16(h) of the Andhra Pradesh State and Subordinate Service Rules as interpreted by the Honourable High Court in their Judgement in W.P.No.22978/2008 and Batch, dated 18-12-2008 and accordingly revise the promotions already given

The  procedure  as  interpreted  by  the  Hon’ble  High  Court  of  AP,  in  their Judgement dated 18-12-2008 in W.P.No. 22978/2008 and batch, Government have called for proposals from the Commissioner of Social Welfare for invoking Rule 16(h) of AP State & Sub-ordinate Service Rules, 1996 for revision of date of commencement of probation to the Gr-II HWOs who have passed the required departmental test beyond the period of probation.

The  Commissioner  of  Social Welfare,  A.P., Hyderabad has submitted additional proposals and stated that  (55) Hostel welfare Officers who were initially appointed as Grade.II HWOs in Mahabubnagar District have passed the Departmental Tests beyond the period of probation, and has requested the Government to issue necessary orders on the implementation of Rules 16(h) of AP State & Sub-ordinate Services Rules, 1996. In this District the appointing authority has not extended the period of probation for passing the requisite Departmental Test for a period of one year under Rule 17(b) of AP State & Sub-ordinate services Rules, 1996.

The power to extend the period of probation is vested with the Government by way of relaxation of power under Rule 31 of AP State & Sub-ordinate Services Rules, 1996.  The  Commissioner  of  Social Welfare,  AP,  Hyderabad  /  the  District  Collector concerned has furnished the dates of publication of the results of Departmental Test.

Now, the Government have decided to extend the period of probation from the date of their appointment to the revised date of commencement of probation as per Rule 16(h) of AP State & Sub-ordinate Services Rules, 1996 (24 (c) of old rules).

Accordingly, Government hereby extend the period of probation of (55) Hostel Welfare Officers Grade.II,  who have not  passed  the  Departmental Test  within  the period of probation in Mahabubnagar District upto the date as mentioned in Column No.6 of  the Annexure and also revise the date of  commencement of probation as indicated in the column No.7 of the Annexure under Rule 16(h) of AP State & Sub- ordinate Services Rules, 1996. Subject to out come of the order of Hon’ble High Court of A.P. in W.P. filed by the Government against the orders of Hon’ble APAT in O.A.No. 5119/2011 and batch dated: 18-10-2012.

Accordingly, Government hereby extend the period of probation of (26) Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Guntur District

7 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Adilabad District

68 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Nellore District

29 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Prakasam District

57) Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Kurnool District

19 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Nizamabad District

61 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in West Godavari District

42 Hostel Welfare Officers Grade.II, who have not passed the Departmental Test within the period of probation in Khammam District

The appointing authority shall take necessary action to declare probation of the officers as per rules in force.

    Good evening sir , I have some questions to clarify from sc. welfare dept telangna state . 1, For the promotions is any reserved seats for women any category .. 2,what is the rules and regulations to get promotion from grade2 to grade 1 HWOs. 3,is there any rule to denied to give promotion juniors with probation and regularisation completed. 4, if the candidate not passed account test within the period I.e 2 years is he eligible to get promotion 5, when denied to give promotion to junior is there any right to proceed for justice 6, there is 5 posts only 4 are eligible from seniors . Juniors are eligible to get another one post or can vacate for later passed seniors to reserve until he came with passing Sir give complete information with GO s thanking u sir
