Imposition of penalty of two annual grade Increments to Panchayat Secretary


Sri  J.Rambabu,  Panchayat Secretary , Gram Panchayat, (Retd), Chillakallu, Krishna District has preferred  an appeal to the Government against the orders issued by the disciplinary authority i.e., Commissioner, Panchayat Raj and Rural Employment, A.P.,   Hyderabad  imposing a penalty of stoppage of two annual grade increments with cumulative effect for the irregularities committed by him in the administration of the Gram Panchayat, Vatsavai, Krishna District, while he was working there as Panchayat Secretary.

The Commissioner, Panchayat Raj and Rural Employment, A.P.,  Hyderabad has reported that as per the report submitted by the District Collector (PW),Krishna District the individual was placed under suspension and  three articles of charge were issued to the individual in the disciplinary case for the irregularities committed by him in the administration of the Gram Panchayat , Vatsavai ,Krishna District. The CEO,ZPP and the DPO Krishna were appointed as enquiry officer and presenting officer respectively to conduct the enquiry in the matter  as per the APCS(CCA)Rules,1991 as the individual was denied the articles of charge issued to him. The Enquiry officer in his enquiry report has stated that in all the three charges issued to him , no financial misappropriation was taken place and it was only procedural lapses. The Commissioner, Panchayat Raj and Rural Employment, A.P.,  Hyderabad after examination of the case  has issued orders imposing a penalty of stoppage of two annual grade increments with cumulative effect.

The Commissioner, Panchayat Raj and Rural Employment, A.P., Hyderabad  duly furnishing the original connected records of the case, has requested to issue necessary orders in the matter.

The individual in his appeal  has submitted that the Sarpanch of the Gram Panchayat, Vatsavai has threatened him to draw the amounts while he   was on   election   duty.  The   Sarpanch   himself   has drawn the amounts without his knowledge  and the same was brought to the notice of the higher authorities and they were issued orders withdrawing the Cheque powers of the Sarpanch. Further as per the notice of the  District Collector, the Sarpanch has remitted the entire amounts which was irregularly drawn by him into  the Government  Treasury  in various Heads of Account.

Finally  the  individual  has  submitted  that  the  facts  are  already brought to the notice of the authorities i.e. District Collector, Krishna District  and there is no fault on his side for the irregular drawls made by the Sarpanch and requested the Government to restore the said two annual grade increments which are withhold by the Commissioner, Panchayat Raj and Rural Employment, A.P.,  Hyderabad  with cumulative effect, as he was going to be retire within two months.

After careful examination of the matter with reference to material and records available, the Government allow the  appeal submitted by the individual and hereby modify   the penalty of stoppage of two  annual grade increments with cumulative effect imposed on Sri J.Rambabu, Panchayat Secretary, Gram Panchayat, (Retd), Chillakallu, Krishna District by      the  Commissioner,  Panchayat  Raj  and  Rural  Employment,  A.P., Hyderabad in the Procgs. Dtd.19.11.2011 for the  irregularities committed in the administration of the Gram Panchayat Vatsavai, Krishna District, to that of two annual grade increments without cumulative effect.

The Commissioner, Panchayat Raj and Rural Employment, A.P., Hyderabad  is requested to take necessary action in the matter.

Original  record  bearing  the  No.2731/CPR&RE/B1/2010  with  C.F. Pages   1-301   and   N.F.  Pages   1-16   is   returned  herewith  to   the Commissioner, Panchayat Raj and Rural Employment, A.P.,   Hyderabad and he is requested to acknowledge the same immediately.
