CBI Court Issued Samans to Sabitha Indra Reddy and 11 others. All the 12 should attend court on 7 June 2013. The chargesheet filed on April 8,2013 exclusively deals with the Dalmia Cements fraud. Sabita was charged with doling out more than 1,005 acres of limestone mines belonging to the state to Dalmia Cements through a deceptive route just to facilitate the process of the cement company investing Rs 95 crore in Jagan’s cement company as part of a quid-pro-quo arrangement. The limestone lease was initially given to Eswar Cements which subsequently transferred it to Dalmia Cements.
The fifth charge sheet filed on Monday evening by the CBI has 62 pages, 53 documents and says they had examined 46 witnesses. It has named 13 accused including Jagan Mohan Reddy as accused number one. The other accused are Vijay Saireddy, Dalmia Cements MD Puneet, State Home Minister Sabita Indra Reddy, suspended IAS officer Srilaxmi, former mines director VD Rajagopal, and other officials of Raghuram Cements, Ishwar Cements and Dalmia Cements.

Mining Lease for Limestone (Cement Grade) was granted, over an extent of 407.05 Hectares in various Survey numbers i.e., 84, 85, 86 etc., of Nawabpet and Survey No.1 to 10 etc., of Thalamanchipatnam villages of Mylavaram Mandal, Kadapa District in favour of M/s. Eswar Cements (P) Limited for a period of 30 years. The Mining Lease deed was executed on 24.06.2008 and the lease will be in force up to 23.06.2038.
The Director of Mines & Geology, Hyderabad has stated that M/s.Eswar Cements (P) Ltd., has filed an application for transfer of Mining Lease held by them in favour of M/s.Dalmia Cements (Bharath) Ltd. The Transferor has submitted Notarized affidavit and stated that the lessee company on their own intention transferring the said Mining Lease to M/s Dalmia Cements (Bharth) Ltd. Further the lessee company stated the transferee has agreed for liability, if any, on the said Mining Lease and to abide by the lease deed conditions. Further the transferee i.e., M/s Dalmia Cements (Bharth) Ltd., through a Notarized Affidavit has stated that they are willing to take the Mining Lease held by M/s.Eswar Cements(Pvt) Ltd., over the subject area for the unexpired portion of lease period upto 23.06.2038. The transferee has stated that they are having experience in mining field and would pay the mineral dues, if any, due from the lessee as and when demanded by the Department in future prospective assessment.
Finally the Director of Mines & Geology, Hyderabad has requested the Government to consider for transfer of the Mining Lease held by M/s.Eswar Cements (P) Ltd., for Limestone (C.G) over an extent of 407.05 hectares in various Survey numbers of Nawabpet and Thalamanchipatnam Villages, Mylavaram Mandal, Kadapa District in favour of M/s. Dalmia Cement (Bharath )Ltd., for the unexpired portion of the lease period i.e., up to 23.06.2038 under Rule 37 of M.C Rules 1960.
In the above circumstances and after due consideration of the proposal, Government under Rule 37 of M.C Rules 1960 hereby permit the transfer of the Mining Lease held by M/s.Eswar Cements (P) Ltd., for Limestone (C.G) over an extent of 407.05 hectares in various Survey numbers i.e., 84, 85, 86 etc., of Nawabpet and Survey No.1 to 10 etc., of Thalamanchipatnam Village, Mylavaram Mandal, Kadapa District in favour of M/s. Dalmia Cement (Bharath )Ltd., for the unexpired portion of the lease period i.e., up to 23.06.2038, subject to satisfaction of terms and conditions of M.C. Rules,1960 and the M.M. (D&R) Act,1957.
The transfer lease deed should be executed within three months from the date of this order, as per Rule 37(A) of M.C. Rules,1960 and both the transferor and transferee should pay all mineral revenue dues to the Government till the date of transfer, before execution of transfer lease deed.

Sabita Indra Reddy is the first woman Home Minister of Andhra Pradesh. She was often referred to as ‘chellamma’ or younger sister by Jagan’s father YSR Reddy, who died in a chopper crash in 2009, and often his pet schemes would be launched from her constituency of Chevella in Ranga Reddy district. Sabita has been named for her alleged actions of omission and commission during her stint as mines minister. She has distanced herself from controversial decisions of that time, saying she was in the dark about the contents of certain files in her ministry.
