Holding of Family Courts on every second Saturday and immediate next Sunday


Letter received from the Hon’ble Judge, Supreme Court of India, the Registrar (Vigilance), High Court of Andhra Pradesh,  submitted  a  proposal,  to  hold  family  courts  in  the  state  on experimental basis on every second Saturday and immediate Sunday in a month with a view to  provide convenient timing to working couple  and to pay a proportionate remuneration to the officers and staff of the Family Courts for the additional work.

As per the directions of Hon’ble High Court of Andhra Pradesh, Family Courts in all the Districts are holding Family courts on every Second Saturday and immediate next Sunday for disposal of Family Court matters by rendering speedy justice to the litigant public except in Nizamabad District. Ever since the cases relating to the Family Court matters are being posted and some cases are also being disposed by the Family Courts on the said two days in every month. Thus from November, 2011 to November, 2012 a total no. of 400 cases  have been disposed off.

Therefore, the approximate total expenditure towards remuneration per day for each Family Court and also per annum, payable to the officer and staff, would be as follows:

1. Per day, per each Family Court, the remuneration would be:             Rs.20,000/-

2. Expenditure for two days, per each Family Court:  Rs.40,000/-

3. Therefore, expenditure for 24 Family Courts, per day :     Rs. 4,80,000/- (Rs.20,000/- x 24 Family Courts)

4. Expenditure for 24 Family Courts, for two days:    Rs.9,60,000/- (Rs.40,000/- x 24 Family Courts)

5. Total expenditure for 24 Family Courts, per annum:  Rs.1,15,20,000/- (Rs.9,60,000/- x 12 months)

Thus, an amount of Rs.1,15,20,000/- would be incurred per annum, for functioning of 24 Family Courts on every Second Saturday and immediately next Sunday. Government have issued orders for establishment of Family Court at Nizamabad District with staff and expenditure vide G.O.Ms.No.87, Law (LA&J- Home-Courts.C) Department, dated: 01-08-2011, and G.O.Ms.No.342, Finance (SMPC) Department, dated:22.12.2012, respectively. In this connection, the total expenditure for 24 Family Courts + 1 Family Court (at Nizamabad) per annum comes to Rs.1,15,20,000/- + Rs.40,000/- = Rs.1,15,60,000/- only.

The  Registrar  (Vigilance),  has  requested  the  Government  to  accord sanction a Family Court function in each District and also Family Courts at Metropolitan Cities, Hyderabad, Visakhapatnam and Vijayawada and payment of proportionate remuneration to the Officers and staff for attending to additional work on every Second Saturday and immediately next Sunday in a month i.e. from the month of November, 2011.

Government after examination of the proposal, hereby accord sanction for an amount of Rs.1,15,60,000/- (Rupees One Crore, Fifteen Lakhs and Sixty thousands only) per annum towards payment of proportionate remuneration to the officers and staff of each Family Court functioning in each District and also Family Courts at Metropolitan Cities Hyderabad, Visakhapatnam and Vijayawada on their attending work on every Second Saturday and immediate next Sunday from the month of November, 2011. The expenditure shall be met from the 13th  Finance Commission grants released under morning and evening courts, subject to the expenditure can be booked under Morning and Evening Courts.

The  Registrar  (Vigilance),  High  Court  of  Andhra  Pradesh,  shall  take necessary action accordingly.

This order issues with the concurrence of Finance Department, vide their U.O.No.8428/243/FC.I/2013, dated:24-09-2013.
