Fishing Licensing System in Tungabahdra River and Sunkesula Barrage


PRELIMINARY NOTIFICATION

(G.O.Ms.No.2, Animal Husbandry,Dairy Development & Fisheries (Fish) Department, Dated.18 -01-2016)

(Draft Rules for introducing license system in Tungabahdra River and Sunkesula Barrage along with its tributaries etc, of Kurnool District )

The following draft rules of which it is proposed to be made in exercise of the powers conferred by sub-section (1) of section 6 of the Indian Fisheries Act, 1897 (Central Act No.4 of 1897) to regulate and control of fishing in the reservoirs and their channels as in Schedule ‘F’ are hereby published for general information as required by sub section (6) of Section (6) of the said Act.

Notice is hereby given that the said draft rules will be taken into consideration on or after expiry of thirty days from the date of their publication in the Andhra Pradesh Gazette, and any objections or suggestions which may be received from any person with respect thereto, before the expiry of the said period, will be considered by the Government.

The objections or suggestions, if any, shall be addressed to the Principal Secretary to Government. Animal Husbandry, Dairy Development and Fisheries Department, Government of Andhra Pradesh, Hyderabad through the Commissioner / Director of Fisheries, Hyderabad.

Rules:-

(1) These rules may be called the Andhra Pradesh State (Regulation and control of Fishing) in the Tungabahdra River and Sunkesula Barrage along with its tributaries etc, of Kurnool District.

They shall apply to Tungabahdra River and Sunkesula Barrage along with its tributaries etc, of Kurnool District.

  1. Definitions:- In these rules, unless the context otherwise requires
  • “Fishing means any act or activity for the purpose of taking fish from any water”.
  • “Commissioner / Director” means the Commissioner of Fisheries / Director of Fisheries appointed by the Government and any other officers on whom all or any of the powers of the Commissioner / Director of Fisheries conferred.

(c) “Competent Authority” means the Dy. Director of Fisheries or any other Fisheries officer authorized by him not below the rank of Asst. Inspector of Fisheries.

  • “Fish Sanctuary” means any area so declared by the State Government by notification for fish sanctuary in Andhra Pradesh Gazette from time to time.
  • “Inspecting Officer” means the Assistant Director of Fisheries or any officer authorized by him not below the rank of Assistant Inspector of Fisheries.
  • “Tackle” means any kind of apparatus, instrument or tool operated manually or mechanically in waters for catching / harvesting of Aquatic organism / plant whether live or dead;
  • “Pandijal / Dragnet” means the net operated by taking into water with one end at the shore and other end is brought to shore after shotting the net. The net is dragged to shore by men / women at each end. Floats and weights are used;
  • “Gill-net” means the net is a long gill net with / without weights and floats operated in shallow and deep waters;
  • “Valakattu” means the net used for fishing by fixing the net at certain place or by keeping the net stationery.
  1. No fishing shall be permitted in the waters as specified in Schedule “A” to these rules by any contrivance.
  1. No person shall fish in the waters as specified in Schedule “B” to these rules with any contrivance during the period commencing from the 1st day of July to 31st day of August (both days inclusive) of the year and no person shall fish with any nets, which is 25mm or less from knot to knot or with any basket trap or any other fixed engines whose slivers are less than 25mm apart in the said waters during the period commencing from the 1st day of September to 30th day of June (both days inclusive) of the succeeding year.
  1. The fishermen shall apply in writing, for issue of license to the competent authority. The terms and condition for the issue of a license shall be as follows, namely:-

TERMS & CONDITIONS:-

  • The license shall not be transferable.
  • The licensee shall be bound by all the conditions, prescribed from time to time during the period of license.
  • The licensee shall carry with him, his license while fishing and shall produce on demand for inspection to the Inspecting Officer concerned
  • Fishing rights shall not be claimed as a matter of right and shall only be given under the discretion of the competent authority to issue it.
  • No person shall fish in the waters specified in the license with any net whose mesh is below 25mm from knot to knot when it is wet or any basket trap whose slivers are below 25mm apart during the period when / fishing under the rules.
  • Fish of less than 200mm in length of the specified below shall, if caught, be released alive into the water.
  • Catla catla
  • Labeo fimbriatu
  • Labeo rohita
  • Cirrhina mrigala
  • Cyprinus carpio
  • Licensee should not operate any net of more than 450 feet in length.
  • Llicensee shall not operate Pandijal (Foresnice) drag net; and
  • A bonafied fisherman living in the villages within 10 kms from the periphery of the reservoir is entitled to get the license.
  1. The license shall be issued by the Asst. Director of fisheries or any other officer authorized by him not below the rank of an Asst. Inspector of Fisheries in the form set forth in Schedule “B” to these rules. The Asst. Director of Fisheries shall furnish a listof license holders to the local Irrigation and Power Authorities every year.
  1. No person or persons shall catch in the waters with any contrivance or be other methods, any of the fish as specified in Schedule “C” to these rules which measures less than 200mm in length, during the period when fishing is permitted under the above rules and if any such of the fishes are caught, they shall be released alive into the waters.
  1. No person shall fish, in the waters without a valid license for the period as specified in item (ii) of Schedule “B” to these rules.
  1. The fees chargeable for fishing in the waters shall be as specified in Schedule “D” to these rules. A list of license holders will be furnished to the local irrigation and power authorities by the Asst. Director of Fisheries every year.
  1. The Dy. Director of Fisheries or any other officer authorized by him not below the rank of Asst. Inspector of Fisheries may cancel a license, if the licensee violates any of these rules, after giving him a reasonable opportunity to explain. If the license is cancelled, the licensee shall not be entitled for the further fishing in the waters. However, the aggrieved licensee may appeal to the Regional Dy. Director of Fisheries
  1. Any person who is in possession of fish within a radius of 1 km from the parameter of reservoir (on both sides) shall give reasons to the satisfaction of the concerned Asst. Director of Fisheries or any of the officials, authorized by him as to how he is in possession of the fish.
  1. No persons shall erect a Valakattu Addavals any where in the waters as specified in Schedule “A” to these rules
13. Not withstanding  nything contained in these rules, fishing may be permitted by or with the
  orders of the Asst. Director of Fisheries for the purpose of experiments or for stocking them in
  the Departmental waters.  
14. The officer of the Fisheries Department, who is authorized to issue licenses under these rules,
  shall seize the fish caught, any type of fishing gear craft operated and any nets used in
  contravention of these rules. He may also auction the fish so confiscated to avoid spoilage. The
  sale proceeds of such auction shall be remitted to Government account.  

 

  1. A Magistrate of the First class may, while convicting any person for the breach of aforesaid rule or rules, order the seizure, forfeiture or removal of the craft and tackle or any fixed appliance.

 

  1. Whoever commits a breach of these rules shall be punishable with fine, which may extend to Rs.500/- (rupees Five Hundred Only) and when the branch is a continuing one, his license shall be liable for cancellation.
  1. The licensee shall bring his catches to a specified landing centre and provide necessary fish catching data as and when directed by the Asst. Director of Fisheries or his nominee.
  1. The licensee shall conduct fishing within the specified area in the reservoir as may be indicated by the Asst. Director of fisheries or his nominee in the license.
  1. No person shall erect any fixed engines to bailout water with a view to catch fish in the waters.
  1. No licensee is permitted to sue any motorized craft for fishing in the reservoir.
  1. The licensee shall surrender his catches to the District Fishermen Co-operative Societies, Apex Society, or the authorized agency, at the rates fixed by the    Commissioner/Director of Fisheries, Andhra Pradesh, Hyderabad.
  1. The licensee is prohibited fishing by poisoning, shooting, using dynamites or other explosive substance.

SCHEDULE “A”

(See Rule 3)

  1. No fishing of any sort shall be made in the waters lying, within 10 meters from the Reservoir Dam on either side of the reservoir during the entire year.
  1. No fishing shall be conducted within 100 meters below the sluice gates or regulators in the canals or distributaries of reservoirs and their channels as specified in Schedule “F” during the entire year.

SCHEDULE “B” (See rule 4 & 8)

 

  1. Closed season

 

Closed season for two months (i.e) from 1st day of July to 31st day of August (both days inclusive) of the year is to be observed in the Reservoir waters of the reservoirs and their channels as specified in Schedule “F” reservoirs and up to 5 kms in its up-streams.

 

  1. Mesh or Silver regulations:

 

Mesh regulations of 25mm or below from knot to knot or with any basket trap or any other fixed engine whose slivers are less than 25mm apart is imposed in the reservoir and its streams upto an extent of 5 kms during the period commencing form 1st day of September to 30th day of June of the succeeding year (both days inclusive) in the reservoirs and their channels as specified in Schedule “F”.

The following verities of the fishes are prohibited to be caught below 200 mm in length.

  1. The license shall not be transferable.

  1. The licensee shall conduct fishing within the specified area in the reservoir as may be indicated by the Dy. Director of Fisheries or his nominee in the license.
  1. The Dy. Director of Fisheries or any other officer authorized by him not below the rank of Asst. Inspector of Fisheries may cancel a license, it the licensee violates any of these rules, after giving him a reasonable opportunity to explain. If the license is cancelled, the licensee shall not be entitled for the further fishing in the waters. However, the aggrieved licensee may appeal to the Regional Deputy Director of Fisheries concerned.
  1. No person shall erect any fixed engines to bail out water with a view to catch fish in the waters.
  1. No licensee is permitted to use any notarised craft for fishing in the reservoir.
  1. The licensee shall surrender his catches to the District Fishermen Co-operative Societies, Apex Society, or the Authorised Agency, at the rates fixed by the Commissioner / Director of Fisheries Andhra Pradesh, Hyderabad and
  1. The licensee is prohibited fishing by poisoning, shooting, explosive substance, bombing and stupefaction.

O R D E R : In the circumstances reported by the Commissioner of Fisheries, Andhra Pradesh, Hyderabad in his letter read 2nd above, Government hereby accord permission to the Commissioner of Fisheries, Andhra Pradesh, Hyderabad for introducing licensing system in Tungabahdra River and Sunkesula Barrage along with its tributaries etc, Kurnool District in the best interest of fishermen living around and Tungabahdra River and Sunkesula Barrage along with its tributaries with the fees prescribed in the G.O. 1st read above, subject to condition that fishing shall not be undertaken during the conservation period. The draft rules and terms and conditions furnished in the reference 2nd read above are also accepted, and appended to this order.
  5. 2. The Commissioner of Fisheries, Andhra Pradesh, Hyderabad, shall give licenses to all the eligible skilled fishermen strictly following the rules and instructions and take necessary action in the matter, accordingly. (BY ORDER AND IN THE NAME OF THE GOVERNOR OF ANDHRA PRADESH)
