Directions to the Bagasse Cogeneration Developers for generation of power by using coal


Orders were issued to direct the Cogeneration Project Developers under section 11 of the Electricity Act, 2003 to generate the power by using coal as fuel during the non-crushing season from the date of issue of orders till the start of next crushing season and supply to DISCOMs at the rate fixed by APERC.

APPCC & CMD, APTRANSCO, Hyderabad has informed that the South Indian Sugar Mills Association(SISMA)  have requested to allow their plants to generate power using coal operation from the current season to 15.11.2014 or date of start of crushing operation for the next year whichever is earlier. Further, the Chairman, APPCC has stated that the APPCC has examined the issue and decided to submit this issue to Govt. of AP to issue necessary directions to Bagasse cogeneration developers by exercising the powers under section 11 of Electricity Act 2003, for power generation using coal in the non-crushing season and to supply the same at the tariff of lowest (L1) short term rate or the tariff fixed by APERC, whichever is lower.

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 11 of the Electricity Act, 2003, the Government after careful examination of the proposal, hereby permit all Sugar Mills having co-generation facility capable of running with coal, for power generation using coal as fuel during the non-crushing season from the date of issue of orders till the start of next crushing season and supply to DISCOMs at the rate fixed by APERC. However, permission to generate power by using coal will be given only after a certificate is issued by the Cane Commissioner confirming completion of crushing operation as well as non-availability of Bagasse with Sugar Plants.

The Secretary, Andhra Pradesh Electricity Regulatory Commission is requested to intimate the compensation payable in terms of the provisions of the said Act.

The APDISCOMS and Cane Commissioner are requested to take appropriate action in implementing this order.

The CMD, APTRANSCO and the Secretary, Andhra Pradesh Electricity Regulatory Commission shall take further action, accordingly.
