Andhra Pradesh Municipalities Reservation of Seats 2013


The Andhra Pradesh Municipal Corporations (Reservation of Seats) Rules, 1995 and Andhra Pradesh Municipalities (Reservation of Seats in Municipal Councils and Nagar Panchayats) Rules, 1995 provides for reservation of seats for members belonging to Scheduled Tribes, Schedule Castes and women in the wards of Municipalities and Nagar Panchayats with reference to largest percentage of population of the said categories to the total population of the ward in the descending order. To arrive at such reservations, ward wise Scheduled Tribes, Schedule Castes and Women population figures are required. In the Census-2011 population figures published by the Registrar General and Census Commissioner, New Delhi, only revenue ward wise information in respect of Municipalities and Nagar Panchayats Revenue Village wise in rural data is available, but it was not made available Enumeration Block wise.

The Registrar General and Census Commissioner, India was therefore consulted for providing of Enumeration Block level information in respect of Scheduled Tribes, Scheduled Castes and women, but in turn they have informed that such information is not in public domain as reported in the reference.

In view of the above, the Commissioner & Director of Municipal Administration, Hyderabad while discussing the rules and the circumstances of  amendment of Rule 10 for making reservations to BC category which is being followed since 2002 onwards, has reported in the reference 3rd above that rules relating to Scheduled Tribes, Scheduled Castes and Women needs to be amended in absence of Enumeration Block wise and ward wise population figures on the same analogy and has accordingly proposed amendments to the Andhra Pradesh Municipal Corporations (Reservation of Seats) Rules, 1995.

Government after careful examination of the matter have decided to amend the Andhra Pradesh Municipal Corporations (Reservation of Seats) Rules, 1995 and Andhra Pradesh Municipalities (Reservation of Seats in Municipal Councils and Nagar Panchayats) Rules, 1995 accordingly

In the said rules in Municipal Corporations :

1      For the third proviso under rule 6, the following shall be substituted, namely:-

“Provided also that the reservation of seats for women belonging to Scheduled Tribes, Schedule Castes or Backward Classes as the case may be, shall be made from among the wards reserved for these categories in which the percentage of voters of women is the largest in descending order”

For rule 9, the following shall be substituted, namely:-

“9 Manner of Reservation: The reservation of seats for members belonging to Scheduled Tribes, Scheduled Castes and Women in the Wards of the Municipal Corporations shall be made with reference to largest percentage of voters of the said category to the total voters of the ward in the descending order”

3.  For rule 11, the following shall be substituted, namely:-

“11 Reservation of seats to Women: Reservation of seats for Women other than those provided for Scheduled Tribes, Scheduled Castes, Back Ward Classes shall be made from among the wards in which the percentage of voters of Women is the largest in descending order.”’

In the said Rules in Municipal Councils and Nagar Panchayats:

For rule 8, the following shall be substituted, namely:-

“8 the reservation of seats for members belonging to Scheduled Tribes, Scheduled Castes and Women in the wards of the Municipalities shall be made with reference to the largest percentage of voters of the said category to the total voters of the ward in the descending order.”

 For the third proviso under rule 10, the following shall be substituted, namely:-

“Provided also that the sub reservation of seats for women belonging to Scheduled Tribes, Scheduled Castes and Backward Classes as the case may be, shall be made from among the wards reserved for these categories in which the percentage of voters of women is the largest in descending order”.

For rule 11, the following shall be substituted, namely:-

“11 Reservation of remaining seats reserved for women shall be made from among the wards in which the percentage of voters of women is the largest in descending order.”
