Misappropriation of funds in Government Junior College


Whereas, the Commissioner of Intermediate Education, A.P., Hyderabad vide his letter has informed that Sri P.Jagannadham, Principal, Government Junior College, Talapula, Ananthapur District was retired from service on 31.12.2005 on attaining the age of superannuation of 58 years, and based on the Depth Inspection report of District Vocational Education Officer, Ananthapur, he has requested the Government to initiate disciplinary action against the Accused Officer, under Rule 9 of A.P.R.P.Rs.,1980 for the irregularities committed by him.

After careful examination, Government initiated departmental proceedings against Sri P. Jagannadham, Principal (Retd.), Government Junior College, Talapula, Ananthapur District and articles of charges were framed against the above A.O. on the allegations of misappropriation of Government funds during the period from 06-12-2003 to 31-12-2005 while he worked as Principal of the said college

The Accused Officer in his written statement of defense, among other things, has denied the charges framed against him, vide reference 4th read above. After examination of the written statement of defense, the Regional Joint Director of Intermediate Education, Kadapa was appointed as Enquiry Officer, vide reference 5th read above. The Enquiry Officer in his findings has reported that Accused Officer has misappropriated an amount of Rs.22,984/-, and also stated that under Charge-I also the vouchers are not produced to the expenditure incurred for Rs.1500/- under miscellaneous head during 2003-2004.

The Government, after careful examination of the case and keeping in view the guidelines issued in G.O.Ms.No.25, G.A.(Ser.C) Deptt., dt.3-2-2004, have provisionally decided to withhold the pension and gratuity of Sri P.Jagannadham, Principal (Retired), Government Junior College, Talapula, Ananthapur District, in full, besides recovery of Rs.24,984/- from him, under Rule 9 (7) of A.P.Revised Pension Rules,1980. Accordingly, the Show Cause Notice was issued to the Accused Officer, vide reference 6th read above.

In response to the Show Cause Notice, the Charged Officer has submitted his explanation, raising certain other issues. The Director of Intermediate Education, A.P., while offering his views on the explanation of the Charged Officer, has stated that the issues raised by the Charged Officer are nothing but cooked up stories as it appears. Enquiry is clear and charges are established to that account and the report of the Director of Intermediate Education, the explanation of the Accused Officer is not convinced, vide reference 8th read above.

The APPSC, Hyderabad were consulted for their concurrence on the provisional decision of Government. The Commission vide reference 9th read above, have opined that the punishment proposed is on higher side and disproportionate to the offence committed, and advised to impose punishment of 10% cut in pension for a period of 10 years besides recovery of an amount of Rs.24,984/- against Sri P. Jagannadham, Principal (Retd.).

Government after re-examination of the entire matter,decided to impose a penalty of “10% cut in pension for a period of ten years besides recovery of an amount of Rs.24, 984/-” against Sri P. Jagannadham, Principal (Retired), Government Junior College, Talapula, Ananthapur District, under Rule 9 (7) of the A.P. Revised Pension Rules,1980. Accordingly, a revised show cause notice vide reference 10th read above has been issued to the above Charged Officer, as to why a penalty of “10% cut in pension for a period of ten years besides recovery of an amount of Rs.24,984/ ” should not be imposed against him. He was directed to submit his explanation within 10 days from the date of receipt of the orders. If no reply is received within the time stipulated, it will be construed that he has no case to defend and final action will be initiated basing on the material made available in the matter against him.

The Commissioner of Intermediate Education, A.P., Hyderabad vide reference 11th read above, has informed that the revised show cause notice was communicated to the individual vide Proceedings dt.17.7.2012, but no explanation has been received, hence Government may take necessary action on him. Hence, Government have decided to impose the penalty of 10% cut in pension for a period of ten years, besides recovery of an amount of Rs.24,484/- against Sri P. Jagannadham, Principal (Retd.), Govt. Junior College, Talapula, Ananthapur Dist., as proposed in the Show Cause Notice dt.4.6.2012, taking it as no explanation to offer by the Charged Officer to the show cause notice dt.4.6.2012.

Accordingly, the Government under Rule-9 of the Andhra Pradesh Revised Pension Rules, 1980 for the charges held proved in the enquiry, hereby impose the penalty of 10% (ten percent) cut in pension for a period of
10 (ten) years besides recovery of an amount of Rs.24,484/- against Sri P. Jagannadham, Principal (Retd.), Govt. Junior College, Talapula, Ananthapur District.

The Commissioner of Intermediate Education, A.P., Hyderabad shall take further action in the matter, accordingly.
