Irrigation & C.A.D Department Allegations of possession of Assets

It has been brought to the notice of the Government that a Disproportionate Assets case was registered by the Investigating Agency against Sri Bunga Viswanath @ Viswanadham, Assistant Engineer, B.R.R. Vamsadhara Project, Hiramandalam Sub-Division, Srikakulam district, as he had acquired assets disproportionate to the known sources of his legal income vide reference 1st read above.

the Director General, Anti-Corruption Bureau, Hyderabad has sent final report, recommending for prosecution in a court of law under Prevention of Corruption Act, 1988 and also initiate departmental action against the said accused officer for violation of A.P. Civil Services (Conduct) Rules, 1964.

orders were issued, according sanction for the prosecution of the said accused officer Sri. B. Viswanath @ Viswanadham, Assistant Engineer, in a competent Court of Law under Prevention of Corruption Act, 1988.

Departmental action was initiated against Sri. B. Viswanath @ Viswanadham, Assistant Engineer by issuing Articles of Charges framed against him, for violation of Andhra Pradesh Civil Services (Conduct) Rules, 1964.
Sri. B. Viswanath @ Viswanadham, Assistant Engineer in his written statement of self defence, has requested to take appropriate action as deemed fit may be taken in the matter, since the issues are being tried in the Criminal Court (ACB Court, Visakhapatnam).

the Engineer-in-Chief (A.W.), Irrigation & C.A.D. Department, Hyderabad was informed that the written statement of self defence submitted by Sri. B. Viswanath @ Viswanadham, Assistant Engineer is not satisfactory and accordingly he was directed to institute an enquiry into the charges framed against the accused officer Sri B. Viswanath @ Viswanadham, Assistant Engineer under the provisions of Andhra Pradesh Civil Services (CC & A) Rules, 1991 duly appointing a competent Inquiry Officer of proven integrity, and also a Presenting Officer in consultation with the Director General, Anti-Corruption Bureau, Hyderabad, with the directions that the inquiry as per the C.C.A. Rules should be completed within three months and furnish the inquiry report to Government, for taking necessary further action in the matter.

Accordingly, the Engineer-in-Chief (A.W.), Irrigation & C.A.D. Department, Hyderabad issued orders in the reference 7th read above, appointing the Superintending Engineer, B.R.R. Vamsadhara Project Circle, Srikakulam as Enquiry Officer, for conducting departmental enquiry into the charges framed against Sri B. Viswanath @ Viswanadham, Assistant Engineer.

the Hon’ble Court of Special Judge for A.C.B. Cases, Visakhapatnam in its Judgement dated 14.02.2012 in C.C.No.6/2011 held that –

“On 14.02.2012 death certificate of Accused officer filed by the prosecution and the case against the Accused Officer is abated.”

In the reference 9th read above, Smt. B. Janaki, wife of late (Sri) B. Viswanath has informed that her husband Sri. B. Viswanath, Assistant Engineer expired on 25.12.2011 and requested to regularize the arrest period of her deceased husband from 10.06.2009 to 17.06.2009 as a duty period, and pay the salary for the same.

While enclosing a copy of the reference 9th read above, the Engineer-in-Chief (A.W.), Irrigation & C.A.D. Department, Hyderabad has requested to take further necessary action in the matter vide reference 10th read above.

After careful examination of the matter, Government have decided to abate the departmental action against Late (Sri) B. Viswanath @ Viswanadham, Assistant Engineer, who expired on 25.12.2011, and to regularize the detention period in police custody from 10.06.2009 to 17.06.2009 as ‘on duty”, and accordingly, it is hereby order to abate the departmental against Late (Sri.) B. Viswanath @ Viswanadham, Assistant Engineer, who expired on 25.12.2011, and to regularize the detention period in police custody from 10.06.2009 to 17.06.2009 as ‘on duty’.

The Engineer-in-Chief (A.W.), Irrigation & C.A.D. Department, Hyderabad shall take further necessary action in the matter accordingly.

This order issues with the concurrence of Finance (FR.II) Department vide their U.O.No.20965/572/FR.II/12, dated 04.08.2012.
