AP Government Given Powers to District Collectors – Disposal of seized sand

Andhra Pradesh Government have issued orders delegating the powers to the District Collectors for disposal of seized sand for utilization of the same for the Government works through M/s. A.P.Mineral Development Corporation Ltd., by way of granting Temporary permits as per Sub rule (2) of Rule 9-M of A.P.Minor Mineral Concession Rules, 1966 in the state with certain conditions mentioned therein while issuing orders for disposal of the seized stocks of the sand for the Government works.

Vice Chairman & Managing Director, M/s A.P.Mineral Development Corporation Ltd., has requested the Government to issue suitable revised orders for disposal of seized sand shall directly taken up by the District Collectors to avoid delay in lifting of sand from the seized points and to supply to the Government  Agencies without involvement of M/s APMDC Ltd.

After  careful  examination  of  the  proposal  of  Vice  Chairman  &  Managing Director, M/s A.P.Mineral Development Corporation Ltd.,  Government under Rule 9- K(3) of A.P.Minor Mineral Concession Rules, 1966,” in partial modification of orders issued in reference 1st  read above, hereby delegate the powers to the District Collectors, for disposal of the Seized sand for the departmental constructions works undertaken by the Government departments/executing Agencies as per the priority as they deem fit and ensure remittance of Seigniorage Charges by the respective departments as required without involvement of M/s APMDC Ltd for lifting of sand from the seized points to avoid delay in the process”. The sale price shall be as per the prevailing SSR rates. To this end, the user Government department/Agency shall remit the S.S.R rate by way of Challan to the following head of account in the process:-

0853 – Non ferrous Mining & Metallurgical Industries.

102   – Mineral Concession Fee

02    – Rents & Royalties

The Director of Mines and Geology,Hyderabad/Vice Chairman &Managing

Director, M/s.APMDC Ltd shall take further necessary action accordingly.

In the reference read above, the Director of Mines & Geology, Hyderabad has stated that,   the Government vide G.O.Rt.No: 270,   Industries & Commerce Department, dated: 30.04.2012 and G.O.Rt.No: 275,  Industries  & Commerce Department, dated:: 03.05.2012 have  accorded permission under Rule 9-K(3) and Rule 9-M of A.P.Minor Mineral Concession Rules, 1966  to him,  to issue Temporary Permits for lifting and supply of 45,173 Cum and 4,083 Cum of seized sand available in East Godavari District through M/s. A.P.Mineral Development Corporation Ltd., for utilization of the said stocks of sand, in the works relating to modernization of Delta Project taken up in East Godavari and West Godavari Districts and also for Rural Water Supply Schemes and other Government works in East Godavari District, keeping in view of the Hon’ble High Court orders dated: 20.04.2012 in W.P.M.P.No:

14892/2012 in W.P.No: 18822/2011 in connection with implead petition filed by

M/s. R.S.V. Constructions and two others, subject to certain conditions.

The Director of Mines & Geology, Hyderabad has also stated that Assistant Director of Mines & Geology, Rajahmundry has seized 752 M3 sand in Sy.No.73/1 in Kurrumili Village, Kapileswarapuram Mandal, East Godavari District  and the Joint Collector & Chairman, District Level Sand Committee, East Godavari District directed the Assistant Director of Mines & Geology, Rajahmundry to request the Director of Mines  &  Geology,  Hyderabad    to  obtain  permission  from  the  Government  for disposal of the said seized sand for utilization of the same for modernization of Delta System, Rural Water Supply Schemes and other Government works.

The Director of Mines & Geology, Hyderabad has also stated that time and again the proposals are being received from the Assistant Director of Mines & Geology, Rajahmundry for disposal of sand stocks as and when they are seizing the illegal sand stocks and proposals will also come from other Assistant Directors of Mines & Geology in the State as and when they seize the illegal sand stocks in their Districts for disposal of the same to utilize in Government works.

The Director of Mines & Geology, Hyderabad, has therefore, requested  the Government to consider and issue orders under Rule 9-K(3) of A.P.Minor Mineral Concession Rules, 1966  delegating the powers to the concerned District Collectors for disposal of seized sand for utilization of the same in the Government works through M/s.A.P.Mineral Development Corporation Ltd., by way of granting Temporary permits as per Sub rule (2) of Rule 9-M of A.P.Minor Mineral Concession Rules, 1966 with the following conditions to  be   imposed by  the District Collectors, while  issuing  orders  for      disposal  of  the  seized  stocks  of  the  sand  in  the Government  works through M/s. A.P.Mineral Development Corporation Ltd., by way of granting temporary permits :

i.          The District Level Committee for sand headed by the Joint collector / Chairman shall identify the requirement of sand for utilization in Govt. works in the District and submit proposal to the District Collector for utilization of the seized sand available in the District.

ii.          The  M/s. A.P.Mineral Development Corporation Ltd., will under the supervision of the Collector of the District take the requisite amount of seized sand and supply it for the Government works.

iii.         The Concerned Collectors will assume full responsibility for the supply, delivery, utilization of the sand and maintenance of the records.

iv.     The  Seigniorage  fee  shall  be  remitted  by  the  M/s.  A.P.Mineral Development Corporation Ltd., to the Asst. Director of Mines & Geology concerned, the Assistant Director of Mines & Geology will then issue way bills to the M/s. A.P.Mineral Development Corporation Ltd., for that specified quantity.

After careful examination of  the proposal of the Director of Mines & Geology,Hyderabad,Government under Rule 9-K(3) of A.P.Minor Mineral Concession Rules,

1966, hereby delegate the powers to the District Collectors  for disposal of seized

sand for utilization of the same for  the Government works through M/s. A.P.Mineral Development Corporation Ltd., by way of granting Temporary permits as per Sub rule (2) of Rule 9-M of A.P.Minor Mineral Concession Rules, 1966  in the state with the conditions as proposed by the Director of Mines & Geology, Hyderabad at para 4 above while issuing orders for disposal of the seized stocks of the sand for the Government works.

The Director of Mines and Geology,Hyderabadshall take further necessary action accordingly.
