Mining Lease for Laterite in favour of Gouthami Mines & Minerals


Director of Mines & Geology, Hyderabad has requested the Government to consider for grant of Mining Lease for Laterite over an extent of Ac. 16.01 acres (or) 6.485 Hectares in Sy.No.2814, 2813, 2856& 2857 (New Survey Numbers) S.No.802/2, 803/2, 801/2& 801/2 (Old Survey Numbers) of Nimmanagar H/o. Ramachandra puram (V), Mulugu Mandal, Warangal Dist for a period of 20 years in favour of M/s Gouthami Mines & Minerals, Prop:Smt.B.Dhana Lakshmi, subject to submission of prior Environmental clearance from Government of India and Consent for Establishment (C.F.E) from A.P. Pollution Control Board as per S.O.No.1533, dated:14-9-06 and further subject to satisfaction of all other terms & conditions of Mines & Minerals (Development & Regulation) Act, 1957 and rules made there under in general and subject to satisfaction of Mineral Concession Rules, 1960. He has also requested the Government to issue a notice to the applicant for submission of Approved Mining Plan as requested under rule 22(4) of Mineral Concession Rules, 1960.

Government have proposed to grant of Mining Lease for Laterite over an extent of Ac. 16.01 acres (or) 6.485 Hectares in Sy.No.2814, 2813, 2856& 2857 (New Survey Numbers) S.No.802/2, 803/2, 801/2& 801/2 (Old Survey Numbers) of Nimmanagar H/o.Ramachandrapuram (V), Mulugu Mandal, Warangal Dist for a period of 20 years in favour of M/s Gouthami Mines & Minerals, Prop:Smt.B.Dhana Lakshmi, subject to submission of prior Environmental clearance from Government of India and Consent for Establishment (C.F.E) from A.P. Pollution Control Board as per S.O.No.1533, dated:14-9-06 and further subject to satisfaction of all other terms & conditions of Mines & Minerals (Development & Regulation) Act, 1957 and rules made there under and also subject to submission of Approved Mining Plan within a period of six (6) months from the date of receipt of the Government Memo under Rule 22(4) of M.C. Rules, 1960.

The Director of Mines & Geology, Hyderabad has stated that the applicant firm has submitted the Mining Plan approved by the Zonal Joint Director of Mines and Geology, Hyderabad vide Letter No.7318/MP/WGL/2011, dated: 31.01.12 and also submitted a copy of clearance obtained from A.P.Pollution Control Board, Zonal  Office,  Hyderabad  vide Order  No.140-WGL/APPCB/ZO- HYD/CFE/2011,dated:27.04.12 and also submitted clearance obtained from state Level Environment Impact Assessment Authority vide Order No.SEIAA/AP/WGL-13/2012-4292, dated:26.03.2012.  The Director of Mines & Geology, Hyderabad has therefore requested the Government  to grant the Mining Lease for Laterite over an extent of Ac. 16.01 acres (or) 6.485  Hectares  in  Sy.No.2814,  2813,  2856&  2857  (New  Survey  Numbers)  S.No.802/2, 803/2, 801/2& 801/2 (Old Survey Numbers)  of Nimmanagar  H/o.Ramachandrapuram  (V), Mulugu Mandal, Warangal Dist for a period of 20 years in favour of M/s Gouthami Mines & Minerals, Prop:Smt.B.Dhana Lakshmi.

The Government  after examination,  hereby grant Mining Lease for Laterite over an extent of Ac. 16.01 acres (or) 6.485 Hectares  in Sy.No.2814,  2813, 2856& 2857 (New  Survey  Numbers)   S.No.802/2,   803/2,   801/2&   801/2  (Old  Survey  Numbers)   of Nimmanagar H/o.Ramachandrapuram  (V), Mulugu Mandal, Warangal Dist for a period of 20 years in favour of M/s Gouthami Mines & Minerals, Prop:Smt.B.Dhana  Lakshmi, subject to satisfaction  of  all  other  terms  and  conditions  of  Mines  and  Minerals  (Development   & Regulation) Act, 1957 and rules made there under in general and subject to satisfaction of Mineral  Concession  Rules,  1960  and  also  to  the  additional  conditions  specified  in  the Appendix to this order.

The rates of royalty, dead rent, surface rent and water charges shall be collectable as follows, or as revised by the Government from time to time.

I.  Rates of Royalty  :

 LATERITE     :

(a)  Zero  point  four  zero  percent   of  London  Metal  Exchange Aluminium metal price chargeable on the contained aluminium metal in ore produced for those dispatched for use in alumina and   aluminium   metal   extraction   or   as   revised   by   the Government from time to time.

(b) Twenty per cent of sale price on ad valorem  basis for those dispatched  for use other  than  alumina  and  aluminium  metal extraction and for export or as revised by the Government from time to time.

II.  Dead rent  

(Rates of Dead rent in Rupees per hectare per annum shall be collectable as follows or as revised by the Government from time to time )

From  the  second   year  of lease 3rd year and 4th year 5th year onwards
200/- 500/- 1000/-

III.Surface rent and Water charges  :  As fixed by the Government from time to time.

The grantee should pay a deposit of Rs.10,000/- as prescribed under Rule 32 of the Mineral Concession Rules, 1960 before the lease is actually executed

The grantee should execute the lease deed within the time limit specified in Rule 31 of Mineral Concession Rules, 1960.

The terms and conditions referred to at paras 4 to 7 of this order are subject to such further modifications,  additions and alterations as may be ordered before the lease deed is executed.

The  Director  of Mines  & Geology,  Hyderabad  is requested  to ensuring  technical competency and financial soundness of the applicant in all respects to operate the proposed mining  and take necessary  further  action for execution  of the lease deed after satisfying himself that the grantee fulfills all the required conditions and other provisions of the Act and Rules  applicable  in this  regard  and  as soon  as the deed  is executed,  the  date  of such execution should be reported to the Government.

Note:   The  grant  is  liable  for  cancellation  should  it  be  found  that  it  was  grossly inequitable  or was  made  under  a mistake  of fact or owing  to misrepresentation or fraud or in excess of authority.
