Telangana Commission for Backward Classes


Telangana Commission for Backward Classes  Government of Telangana with GO number 25 on 22 October 2016 issued Notification to Backward Classes Welfare Department for Telangana Commission for Backward Classes – Constituted.

Andhra Pradesh Commission for Backward Classes Act, 1993 (Act No.20 of 1993) was adapted along with the amendments made from time to time, for the purpose of facilitating its application in the State of Telangana under section 101 of the Central Act.No.6 of 2014 and named as the Telangana Commission for Backward Classes Act, 1993.

An ordinance has been issued amending Sec.3(2)(a) of the Telangana Commission for Backward Classes Act, 1993 (Act.No.20 of 1993).

Whereas, there is an urgent need to constitute the Telangana Commission for Backward Classes, Government after careful examination of the matter in detail decided to constitute the Telangana Commission for Backward Classes.

Government hereby direct that the following notification shall be published in the Extraordinary issue of Telangana Gazette, dated.22.10.2016:

NOTIFICATION

In exercise of the powers conferred by section 3 of Telangana Commission for Backward Classes Act, 1993 (Act.No.20 of 1993) as amended by Telangana Commission for Backward Classes (Amendment) Ordinance 2016 (Telangana Ordinance No.11 of 2016), Government hereby constitute with immediate effect   the   Telangana Commission for Backward Classes with the following :

The Commission shall:-

Examine requests for inclusion of any class of citizens as a Backward Class in the lists and hear complaints of over-inclusion or under-inclusion of any Backward Class in such list and tender such advice to the Government as it deems appropriate;

Examine and make recommendations on any other matter relating to the Backward Classes that may be referred to it by the Government from time to time;

The Commission shall have all the powers of a Civil Court trying a suit and in particular in respect of the following matters namely:-

Summoning and enforcing the attendance of any person from any part of State and examining him on oath;

requiring the discovery and production of any document;

receiving evidence on affidavits;

requisitioning any public record or copy thereof from any court or office;

issuing Commissions for the examination of witnesses and documents; and

any other matter which may be prescribed.

The Commission shall maintain proper accounts and other relevant records and prepare an annual statement of accounts in such form as may be prescribed by the Government in consultation with the Accountant General, Telangana State.

The accounts of the Commission shall be audited by the Accountant General, Telangana State at such intervals as may be specified by him and any expenditure incurred in connection with such audit shall be payable by the Commission to the Accountant General, Telangana State.

The Commission shall prepare in such form and at such time for each financial year as may be prescribed its annual report giving a full account of its activities during the previous financial year and forward a copy thereof to the Government.

The Headquarter of the Commission will be located at Hyderabad.

The Commission shall:-

meet as and when necessary at such time and place as the Chairperson may think fit;

regulate its own procedure;

all orders and decisions of the Commission shall be authenticated by the Member Secretary or any other officer of the Commission duly authorised by the Member Secretary in his/her behalf.

The Chairman and Members of Telangana Commission for Backward Classes except Member-Secretary shall hold office for a term of three years from the date of assumption of office.

All the Department of the Government will furnish such information and documents and provide such assistance as may be required by the Commission from time to time.
