Exemption of Stamp Duty for Allotment of excess lands in Telangana


GO 273 on 1 November 2016 Excess lands declared and taken possession under the provisions of the Urban Land Ceiling Act, 1976 –Allotment of excess lands which are already under occupation of 3rd parties and declarants in core and peripheral areas – Exemption of Stamp Duty and Registration Fees on Conveyance Deeds

Government of Telangana State have issued orders to formulate scheme for regularization/allotment of excess lands to the parties who are in occupation by way of registered documents and issued certain guidelines for regularization/allotment of excess lands which were vested with Government and possession of which has been taken over by the Government under the provisions of principal Act 1976 to the parties in occupation.

Commissioner & Inspector General of Registration & Stamps, Telangana State, Hyderabad has stated that the Government issued policy guidelines for regularization of surplus lands in the hands of third party occupants / land owners vide reference . In the said G.O. the Government have announced the exemption of Stamp Duty, Transfer Duty and Registration Fee. Further, he has stated that as per the Stamp Act, 1899 U/s (9), the Revenue (Registration) Department is the competent to exempt the Stamp Duty and under section 78 of Registration Act, to exempt the Registration fee, if it is in public interest  and requested the Government to issue an appropriate administrative orders for exemption of Stamp duty.

Government after careful examination hereby decided for exemption of Stamp Duty, Registration Fee on Conveyance Deeds Executed by the respective Tahsildars in favour of the applicants who covered under G.O.Ms.No.92, Revenue (ULC) Department, dt.26.05.2016.

Accordingly, the following notifications will be published in an Extraordinary issue of Telangana Gazette dt: 02-11-2016.

NOTIFICATION 1

In exercise of the powers conferred by clause (a) of Subsection (1) of section 9 of the Indian Stamp Act, 1899 (Central Act II of 1899) the Governor of Telangana hereby exempt Stamp Duty to register all Conveyance Deeds issued in favour of the applicants who covered under G.O.Ms.No.92, Revenue (ULC) Department, dt.26.05.2016

NOTIFICTION.II

In exercise of the powers conferred by section 78 of the Registration Act, 1908 (Central Act XVI of 1908) the Governor of Telangana hereby makes the following amendment to the “Table of Fees” under Registration Fees issued in G.O.Ms.No.463, Revenue (Regn.I) Department, dt.17th September, 2013 and published in the Andhra Pradesh Gazette Extraordinary       dated: 26.08.2013.

AMENDMENT

In the said “Table of Fees” in category (1) after serial number, 13 conveyance the following shall be added namely:-  “13 (C) No registration fee shall be levialbe in respect of conveyance deeds executed in favour of the applicants who covered under G.O.Ms.No.92, Revenue (ULC) Department, dt.26.05.2016”.
