The Government of India, enacted the Prevention and control of Infectious and Contagious Diseases in Animals Act, 2009 (Central Act No. 27 of 2009). According to Section 43 of the Act, the State Government may, by notification and with the prior approval of the Central Government, make rules fro carrying out the purposes of this Act.

Accordingly in the reference 3rd read above the State Government had sent draft rules to the Government of India for its prior approval.

Government of India have approved the draft Rules prepared by the State Government.
Accordingly the following notification shall be published in an Extra-Ordinary issue of the Telangana State Gazette, Dated: 28-1-2015:-

Notification

In excersice of the powers conferred under section 43 (1) of the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (Central Act 27 of 2009), the Government of Telangana with the prior approval of Central Government hereby makes the
following rules.

1. Short Title and Commencement

(a) These Rules may be called the Telangana Prevention and Control of Infectious and Contagious Diseases in Animals (Detention of Animals at Check post, compulsory vaccination and grant of permit) Rules 2014.
(b) They shall come into force on the date of their publication in the Gazette of Telangana. 2. Definitions
(a) in these Rules unless the context otherwise requires.
(i) ‘Act’ means The Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (Central Act 27 of 2009);
(ii) ‘Form’ means a form appended to these Rules;
(iii) ‘Section’ means a Section of the Act.

(b) Words and expressions used in these Rules and not separately defined above shall have the same meaning as in the Act.
3. The manner of inspection and the period of detention at a Check Post or at a Quarantine Camp
(a) In order to ascertain whether the animals are infected with any of the scheduled notified disease, the animals stopped at the check posts or detained in the Quarantine Camp shall be inspected by the person in charge of check post of Quarantine Camp for the following:
(i) Movement and gait
(ii) Dull, depressed, normal or excited behavior
(iii) Increase in body temperature
(iv) Ulcer in the mouth, feet or udder
(v) Excessive lacrimation, nasal or vaginal discharge
(vi) Sweating and Shivering
(vii) Dryness of the skin, alopecia, skin rashes
(viii) Weakness
(ix) Bleeding through natural openings, and
(x) Oedema or swelling in dewlap region or any other part of the body
(b) The person Incharge, Check post or Quarantine station shall also collect the necessary samples for laboratory examination, if required.
(c) The person Incharge, Check post may detain animals at Check Post for a period not exceeding 12 hours for the purpose of inspection, compulsory vaccination and identification/marketing etc. For the animals vaccinated at the check post, the animal owner shall be given a vaccination certificate as required in Section 9 of the Act. (d) After examination of the animal, the officer In charge shall either allow entry of the animal to the notified Control Area or Free Area by issuing an Entry Permit in Form A, appended with these Rules; or transport the animals to the Quarantine Camp.
(e) The cost of examining, Vaccinating, ear – tagging the animal at the Check Post shall be fixed by the Director from time to time and shall be borne by the animal owner.
4. Form of Permit granted by Officer in charge Quarantine Camp
(a) The Officer in charge of the Quarantine Camp shall detain the following animals:
(i) Which are suffering from any scheduled notified disease; or
(ii) Which have come into contact with or have been kept in the proximity of animal infected with a scheduled notified disease; or
(iii) Transported by the Officer In Charge; Check post as detailed in rule 3(d): or
(iv) Of the species notified while exiting from the infected area and shall be subjected to a quarantine of 14 days in a Quarantine Camp.
(b) The Officer in charge, Quarantine Camp shall give an official, acknowledgement to the animal owner for the animals detained in the Quarantine Camp. The form of the Detention Acknowledgement is appended as Form B.
(c) During quarantine, the animals shall be ear – tagged having a unique number (for cattle, buffalo, sheep, goat and pigs) and any other suitable method (for donkey, horses). Animals shall be examined regularly for any scheduled disease. Animals shall be vaccinated against
the scheduled disease and provided with veterinary treatment, is required. If animals are vaccinated, the animal owner shall be provided with a vaccination certificate as required in Section 9 of the Act.

(d) The cost of maintenance and vaccination of the animals during the quarantine shall be fixed by the Director from time to time and shall be borne by the animal owner.
(e) After successful quarantine, the Officer in charge, Quarantine Camp shall release the animals to the animal owner and also grant the Quarantine Release Permit as per Form C appended with these Rules, under his signature. Form C shall also serve as Entry Permit as required in Section 15(2) of the Act.
5. Interpretation of rules:
If any question of interpretation or doubt arises in relation to these rules, the matter shall be referred to the Government of Telangana whose decision thereon shall be final and binding.
