Telangana Regulation of Employment and Conditions of Service Rules


Whereas, by virtue of section 3 of the Andhra Pradesh Reorganization Act, 2014 (Central Act No.6 of 2014), the State of Telangana comprising the territories specified therein has been formed on and from the appointed date i.e., of 02.06.2014.

2. And whereas, in section 101 of the Andhra Pradesh Reorganization Act, 2014, a provision has been made for the purpose of facilitating the application of any law (as defined in section 2(f) of the Act), made before the appointed day, in relation to the State of Andhra Pradesh or the State of Telangana, the appropriate Government may before expiration of two years from 02.06.2014, by order, make such adaptations and modifications of the law, whether by way of repeal or amendment, as may be necessary or expedient, and thereupon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority;

And whereas, the Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1999 made under the Building and Other Construction (Regulation of Employment and Conditions of Service) Act, 1996 vide G.O. first read above and published in the Andhra Pradesh Gazette Ext- III, Rules Supplement to Part-I-Extraordinary, dated:16.03.2000.

4. And whereas, after careful examination, Government have decided to adapt the said Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1999 which are in force as on 01.06.2014 with certain modifications.

5. Accordingly, the following notification shall be published in an Extra-ordinary Issue of the Telangana Gazette, dated: 16.12.2015.

NOTIFICATION

In exercise of the powers conferred by section 101 of the Andhra Pradesh Reorganization Act, 2014 (Central Act No.6 of 2014), the Government of Telangana hereby, order for adaptation of the Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1999 to the State of Telangana.

1. This order may be called “The Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1999 (Telangana Adoption) Order, 2015.

2. Throughout the Andhra Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 1999, for the words “Andhra Pradesh” (occurring otherwise than in a citation or description or title of other laws including the Rules as the case may be), the word “Telangana” shall be substituted.

3. In rule 7,

(i) for the words “Government of any State or a Board” the words “State Government or the Board” shall be substituted.

(ii) the words “in that State” shall be deleted.

4. In the rule 24, after sub-rule (1), the following proviso shall be inserted, namely:-

“Provided that if no Adverse order is passed by the Registering Officer within fifteen days from the date of submission of the application, the registration shall be deemed to be duly granted.”

5. In rule 33-J, in sub-rule (1) for the expression “33-J”, “33-I” shall be substituted.

6. In rule 210, in sub-rule (1), in clause (b) in sub clause (i), for the words “Regional Labour Commissioner (Central)” the words “Deputy Commissioner of Labour” shall be substituted.

7. Throughout the rules, for the words “Director General” the words “Chief Inspector” shall be substituted.

8. Throughout the rules, for the words “Central Government” the words “State Government” shall be substituted.

9. Throughout the rules, for the words “Government of India” the words “Government of Telangana” shall be substituted.

10. After rule 252, the following rule shall be added, namely:-

“253. Power to remove difficulties:-

If any difficulty arises in giving effect to the provisions of these Rules, the State Government may by order published in the Official Gazzette, make such provisions not in consistent with the provisions of these rules, as appears to it to be necessary or expedient for removing the difficulty.”
