Telangana Allopathic Private Medical Care Registration & Regulation Act 2002


Whereas, by section 101 of the Andhra Pradesh Re-Organisation Act, 2014 (Central Act No.6 of 2014), the State of Telangana is empowered by order, to make such adaptations and modifications of any law made before 02-06-2014, whether by way of repeal or amendment as may be necessary or expedient, Telangana Allopathic for the purpose of facilitating the application of such law in the State of Telangana before expiration of two years from 02-06-2014 and thereupon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority.

2. And whereas, it has become necessary to adapt, the Andhra Pradesh Allopathic Private Medical Care Establishment (Registration & Regulation) Act, 2002 (Act No.13 of 2002) in force as on 01-06-2014 for the purpose of facilitating its application in relation to the State of Telangana.

3. Now, therefore, after careful examination, Government have decided to adapt the said Andhra Pradesh Allopathic Private Medical Care Establishment Act, 2002 (Act No.13 of 2002) which is in force as on 01-06-2014.

4. Accordingly, the following Notification will be published in an Extraordinary issue of the Telangana State Gazette dt Telangana Allopathic.

NOTIFICATION

In exercise of the powers conferred by section 101 of the Andhra Pradesh Re-organisation Act, 2014 (Central Act No. 6 of 2014), the Government of Telangana State hereby makes the following orders, namely:-

1.(1) This order may be called “The Andhra Pradesh Allopathic Private Medical Care Establishments (Registration & Regulation) Act, 2002” (Telangana Adaptation Order), 2015.

(2) It shall be deemed to have come into force with effect from 02-06-2014.
The Andhra Pradesh General Clauses Act, 1891, shall apply for the interpretation of this order as its applies for the interpretation of a State Act.

For the purpose of this order, and the Act adapted herein, the expression “ the State” shall have the meaning and area as specified in section 3 of the Andhra Pradesh Reorganisation Act, 2014.

In “ The Andhra Pradesh Allopathic Private Medical Care Establishments (Registration & Regulation) Act, 2002” as amended from time to time, throughout the Act, for the words Andhra Pradesh, the word “Telangana” shall be substituted.

The Andhra Pradesh Reorganisation Act, 2014 (Central Act No.6 of 2014)

Whereas by virtue of section 3 of the Andhra Pradesh Reorganisation Act, 2014 (Central Act No. 6 of 2014), the State of Telangana comprising the territories specified therein has been formed on and from the appointed day i.e. of 02-06-2014.

And whereas, in section 101 of the Andhra Pradesh Reorganisation Act,2014 a provision has been made for the purpose of facilitating the application of any law (as defined in section 2(f) of the Act), made before the appointed day, in relation to the State of Andhra Pradesh or the State of Telangana, the appropriate Government may before expiration of two years from 02-06-2014, by order, make such adaptations and modifications of the law, whether by way of repeal or amendment, as may be necessary or expedient, and there upon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority.

And whereas, the Andhra Pradesh Allopathic Private Medical Care Esrablishment (Registration & Regulation) Rules, 2007, made in exercise of the powers conferred under section 18 of the Andhra Pradesh Allopathic Private Medical care Establishment Act, 2002 of the Constitution of India vide G.O. first read above, are in force as on 01-06-2014.

Now, therefore, after careful examination, Government have decided to adapt the said Andhra Pradesh Allopathic Private Medical Care Establishment (Registration & Regulation) Rules, 2007 which are in force as on 01-06-2014.

Accordingly, the following Notification will be published in an Extra-Ordinary issue of Telangana State Gazette dt.

In exercise of the powers conferred by section  101 of the Andhra Pradesh Reorganisation Act, 2014 (Central Act No.6 of 2014), the Governor / Government of Telangana hereby makes the following order, namely:-

1.(1)   This order may be called the Andhra Pradesh Allopathic Private Medical Care Establishment (Registration & Regulation) Rules, 2007 (Telangana Adaptation)Order, 2015.

(2)   It shall be deemed to have come into force with effect from 02-06-2014.

For the purpose of this order and the rules adapted herein, the expression “the State” shall have the meaning and areas specified in section 3 of the Andhra Pradesh Reorganisation Act, 2014.

In “ The Andhra Pradesh Allopathic Private Medical Care Establishment (Registration & Regulation) Rules, 2007, throughout the Rules, for the words “Andhra Pradesh”, occurring otherwise than in a citation or description or in title of other enactments, the word “Telangana” shall be substituted.
