Mining Lease for Limestone to kcp.co.in Limited for a period of 50 Years


Government of AP in Forest Department issued orders for diversion of 24.32 ha. of forest land (i.e. 20.046 ha. in Sy. No. 656/11-B8 of Polepalli Village, Durgi Mandal and 4.274 ha. in Sy No. 689/2-16 in Mandadi Village of Veldurthy Mandal, Guntur District) in Compartment No.82, Mandadi R.F., Macherla Range of Guntur Division / District, for mining lease for lime stone, in favour of M/s. K.C.P. Limited, Macherla, for a period of 20 years with certain conditions Mining Lease for Limestone .

Government have proposed to grant Mining Lease for Limestone over an extent of 4.274 hectares (10.50 acres) in Sy. No. 689/2-16 of Mandadi Block-II RF, Mandadi Village, Veldurthy Mandal, Guntur District for a period of 20 years in favour of M/s. K.C.P. Limited and the applicant company was requested to submit the Mining Plan approved by the IBM through the DM&G, AP, Hyderabad along with CFE from APPCB, prior Environmental clearance from GoI under S.O. 1533, dt.14.09.2006.

Director of Mines & Geology, A.P., Hyderabad has stated that , M/s. K.C.P. Limited vide their letter No. SP-Sr.DGM-127-2015-16, dt. 21-10-2015 furnished the following documents:-

  1. Copy of Mining Plan duly approved by the Indian Bureau of Mines, Hyderabad vide letter No. AP/GNR/MP/Lst-76/Hyd., dt. 9-2-2015.

Copy of environmental Clearance vide Order No. SEIAA/AP/GNT-110/2014-4104, dt. 21-9-2015 from State Level Environment Impact Assessment Authority.

Copy of Consent for Establishment vide Order No. G-569/PCB/ZO-VJA/CFE/2015, dt. 9-10-2015 issued by the Joint Chief Environmental Engineer, Zonal Office, APPCB, Vijayawada.

The DM&G has therefore requested the Government to consider for grant of Mining Lease for Limestone over an extent of 4.274 hectares (10.50 acres) in Sy. No. 689/2-16 of Mandadi Block-II RF, Mandadi Village, Veldurthy Mandal, Guntur District in favour of M/s. K.C.P. Limited for a period of (50) years under Section 8A(2) of MM&DR Amendment Act, 2015.

Government, after careful examination of the matter, hereby grant Mining lease for Limestone over an extent of 4.274 hectares (10.50 acres) in Sy. No. 689/2-16 of Mandadi Block-II RF, Mandadi Village, Veldurthy Mandal, Guntur District in favour of M/s. K.C.P. Limited for a period of (50) years under Section 8A(2) & Section 10 A (2) (c) of Mines & Minerals (Development & Regulation) Amendment Act, 2015 under Rule 22 of Mineral Concession Rules, 1960 for captive purpose, and also subject to condition to obtain the Forest Clearance from time to time. The Mineral shall be used for captive purpose only by the lessee company.

The rates of royalty, dead rent, surface rent and water charges shall be collectable as follows:

  1. ROYALTY:

Limestone: (a) L.D Grade (less than one and half percent. Silica content) : Seventy Two Rupees per tonne

 

(b) others                                                   : Sixty Three Rupees per tonne

  1. Dead Rent:

(Rates of dead rent in rupees per hectare per annum or as revised from time to time)

III. Surface Rent, water Charges and Cess: As fixed by the Government from time to time.

The grantee should execute the lease deed within the time limit specified in Rule 31 of Mineral Concession Rules, 1960.

The grantee should pay a deposit of Rs.10,000/- as prescribed under Rule 32 of the Mineral Concession Rules, 1960 before the lease is actually executed.

The terms and conditions referred to in paras 6 to 8 of this order are subject to such further modifications, additions and alterations as may be ordered before the lease deed is executed.

The Director of Mines and Geology shall take necessary further action for the execution of the lease deed after satisfying himself that the grantee fulfils all the required provisions of the amended Act and Rules. As soon as the deed is executed, the date of such execution should be reported to the Government.

Note: The grant is liable for cancellation, should it be found at a later date that it was grossly inequitable or was made under a mistake of fact or owing to misrepresentation or fraud or in excess of authority.
