According to section 30 of the A.P.Reorganisation Act, 2014 (Central Act 6 of 2014) the High Court of Judicature at Hyderabad shall be the common High Court for the State of Telangana and the State of Andhra Pradesh till a separate High Court for the State of Andhra Pradesh is constituted under Article 214 of the Constitution of India etc. and other provisions of the Act. In addition to the above, there is Andhra Pradesh Administrative Tribunal and certain State Level Courts constituted and established under different enactments.
In terms of Article 165 of the Constitution of India and the Andhra Pradesh Law Officers (Appointment and Conditions of Service) Instructions, 2000 issued in G.O.Ms.No.187, Law, dated: 06.12.2000, the Advocate General and the other law officers viz Government Pleaders, Public Prosecutors, Standing Counsel are being appointed to the Hon’ble High Court, Andhra Pradesh Administrative Tribunal and other State Level Tribunals/Courts established under the relevant enactments, duly following the procedure as provided under the Andhra Pradesh Government Business Rules framed under Article 166 of the Constitution of India.
In pursuance of the A.P.Reorganisation Act, 2014 the appointed day has been notified, by the Central Government, as 2nd June, 2014, from which date two states i.e. the State of Telangana and the State of Andhra Pradesh will be formed.
From the date of formation of the State of Telangana w.e.f the appointed day i.e.02.06.2014 there is every need for Advocate General/ Public Prosecutor/GPs/Standing Counsel to appear before the Hon’ble High Court/Tribunal and other State Level Tribunals/Courts and in normal course it would take considerable time for appointment of the Advocate General/PPs/GPs/Standing Counsel duly following the procedure prescribed under the said Instructions 2000 and the Government Business Rules and in the meanwhile there will be none to appear before the Hon’ble Courts and much difficulty may have to be faced by the States in respect of the cases before the appropriate forums.
After careful examination of the matter, the Governor of Andhra Pradesh hereby continue the Advocate General, Additional Advocates General, State Public Prosecutor and Additional Public Prosecutors, Government Pleaders and Standing Counsel, who have been appointed for the State of Andhra Pradesh and to appear on behalf of the State of Telangana, also beefore the Hon’ble Courts/Tribunals, as interim measure, till such time the appointments are made to the said posts by the respective State Governments and they assume office of the respective posts.
