Andhra Pradesh Women Development and Child Welfare Service Rules were issued. As per rule – 4 of these rules, “ the rule of special representation as enumerated in rule 22 read with Sub – rule (3) of Rule 22 – A of the Andhra Pradesh State and Subordinate Service Rules shall apply to appointments to be made for the posts for which there is provision for Direct Recruitment. The post meant for Direct Recruitment one reserved exclusively being filled by women in terms of Sub – Rule (3) of Rule – 22 A of the A.P. State and Subordinate Service Rules “ and thus it is provided for filling up of the posts in the Women Development & Child Welfare Department, under direct recruitment by women only. The Andhra Pradesh Administrative Tribunal in O.A.No.750 of 2013 and batch cases passed orders dated 14-03-2013, for interim suspension of the Notification No.25/2012, dated 29-12-2012 issued by the APPSC for recruitment of 107 posts of Child Development Project Officers with only women candidates, by observing that there is no Rule framed by the Government reserving 100% posts exclusively for women.
Therefore, Government after careful examination of the matter, have decided to issue the following suitable amendment to Rule 4 of the Andhra Pradesh Women Development and Child Welfare Service Rules, retrospectively i.e. with effect from 01-04-2004 (so as to also include APPSC Notification No.25/2012, dated 29-12-2012) to bring clarity in respect of exclusive reservation of the posts to women candidates in respect of the appointments to be made under direct recruitment.
The following notification will be published in the Andhra Pradesh Gazette: –
In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Government of Andhra Pradesh hereby makes the following amendment retrospectively i.e. with effect from 01-04-2004 to the Andhra Pradesh Women Development and Child Welfare Service Rules as subsequently amended from time to time.
For Rule 4 of the said rules, the following shall be substituted, namely: –
“ The posts of Women and Child Welfare Officer including Child Development Project Officer, I.C.D.S., Additional Child Development Project Officer, I.C.D.S and Manager of Warehouse, under Category – 6 mentioned in Rule – 3 are exclusively ( i.e. 100%) reserved for women candidates only, for Direct Recruitment, in terms of Sub – Rule (3) of Rule – 22 A of the Andhra Pradesh State and Subordinate Service Rules, 1996. “
